Although the vast majority of lawyers won't entertain class actions on a contingency basis (which you are talking about) unless they believe they will win (and win big), they take all the risk and often have to lay out a
lot of money in advance. The downside for complainants in - for example - cases against pharmaceutical companies, is not that the lawyers cream off too much in percentage terms, but that they settle for a sum which when divided around the thousands of people who might be involved, may not appear to pay individual claimants very much.
In any case, although most class actions are fought on a contingency basis because it is usually good strategy to involve as many claimants as possible, they don't have to be. Smaller, richer groups, confident of the result, can pay hourly rates, the same as for any other action.
