Man Sues Over $129,626 Strip Joint Tab

    http://thesmokinggun.com/archive/0603041scores1.html

JUNE 3--A New York City man is suing Gotham's leading gentlemen's club, claiming that his credit cards were billed a whopping $129,626 for a seven-hour stay last year at the East Side strip joint, The Smoking Gun has learned. That's right, $129,626! Did we mention the bill totaled $129,626? According to the below lawsuit, filed May 27 in State Supreme Court, Tauhidul Chaudhury and three friends arrived at the Scores nightclub last October 23 at 9 PM. The quartet drank in the club's bar area until 11 PM, when Chaudhury's cronies departed. Though Chaudhury--a Bangladeshi national who remained at Scores alone until the club closed at 4 AM--was "clearly and obviously intoxicated," Scores employees continued "supplying Chaudhury with the alcoholic beverages and other services, including causing Chaudhury to be admitted into a private room." The complaint does not describe those additional "services" (or any Champagne Room ministrations), but lap dances must have been on the menu. When it was all over, the six-figure tab was spread over four of Chaudhury's credit cards, with the Manhattan man claiming that he "cannot recall authorizing these charges." "If the credit card receipts do contain his signature, he did not possess the requisite mental capacity to authorize these charges," alleges the complaint filed by attorney Robert Cantor. In a brief interview, Chaudhury told TSG that he filed the lawsuit against Scores after his credit card companies rejected his bid to strike the charges. "They did not find reason to decline the payments," said Chaudhury (that's probably because his signature appears on the credit card receipts). Lonnie Hanover, a Scores spokesman, said he had not seen the complaint and could not comment on Chaudhury's claims. This is the second time in two weeks that a former Scores patron has filed a lawsuit accusing the club of improper billing--though the first litigant claims he's out just $28,021, a pittance compared to the gargantuan Chaudhury tab

Even if he DID authorize the charges, there's no way he ran up a legitimate $130,000.

Man Disputes $28,000 Strip Club Bill
          Posted: May 20, 2004 at 12:52 p.m.

NEW YORK (AP) -- An insurance company executive is claiming some financial hanky-panky occurred during a visit to an upscale strip club that left him out $28,000.

Mitchell Blaser, 54, filed a lawsuit Wednesday claiming he was stripped of the money through bogus credit card charges after a night out with two friends at the Manhattan topless club Scores.

A Scores spokesman denied the accusation, saying Blaser was spending "like a rock star" and the club's paperwork proves it. The tab for the evening included $16,000 for five bottles of top-of-the-line Champagne and $7,000 for lap dances.

Blaser, CFO for the American division of Swiss Reinsurance Co., said when he complained that the bill was wrong, club employees told him to sign or he would not get his credit card back.

Scores spokesman Lonnie Hanover said club employees checked with American Express several times during the night while Blaser was there to make sure that his line of credit permitted the kind of spending he was doing.

Hanover said American Express investigated Blaser's complaints in January. He said the credit card company sent Scores a letter dated Jan. 22 confirming that the charges were legitimate.

Steve Dishart, a spokesman for Swiss Reinsurance, one of the world's largest insurers, said he couldn't comment because Blaser's lawsuit involves "a personal dispute."

I worked at a adult club in NYC , when a customer went to pay with cc they would try the card for $1000 immediately so they had a idea of what they could push the guy for. When going to adult clubs in NYC bring no credit cards and only $200 in cash max . Cant get in much trouble that way lol.

                    Very true

Problem is that guys when drunk and horny think with the little head more than with the big one. Robin Williams once said that there's only enough blood in a man to flow through one head at a time. How right he is (Yes, I'm talking from experience).

As to a chargeback, sorry but "I was drunk" as that guy in the first story claims doesn't cut it with me. If they chargeback $100,000 under the "drunk" excuse, it will only be a matter of time before loads of nightclubs, pubs and other watering holes go tits up.

We were fingerprinted at Cheetah in Atlanta during the Webmaster Access. Kinda hard to say it's not your tab when they've got your prints.

A contract is not valid if the party does not have capacity. If he is under the influence the contract/receipt is not valid.

"A totally drunk person also lacks the ability to consent to a contract and has the option of voiding a contract signed while intoxicated, providing it is done at the earliest opportunity upon sobriety."

tyler86ed, I must say that you're right. A contract can be voided at the *EARLIEST* opportunity.

According to the story, that guy decided to get loaded and to have asses rubbing his lap and crotch last October 23.

It's now June. That's just over 7 months.

7 months is NOT the "earliest" opportunity. It's not about being intoxicated beyond having the ability to sign a contract, it's not about statute of limitation. It's about setting a precedent.

If you think it's bad right now for webmasters losing on bullshit chargebacks, what do you think will happen if this guy wins when having his day in court? Every guy jacking off to porn on the web using a credit card will cite that case as a precedent and that will result in more bullshit chargebacks, that's what.

I say that if you signed the credit card slip and waited over 6 bloody months, you deserve to be charged. Call it stupidity, call it procrastination, that guy had it coming.

                                    Cheers,

                                    Mike.
