I believe what you're referring to was when the administrations lawyers said the geneva convention as it exists doesn't apply to terrorists and illegal combatants with no new legislation being necessary. If I remember correctly this policy was only to be applied to the non-taliban foreign fighters and terrorists captured in Afghanistan.
