    Paris Hilton Video - I don't understand.

    Someone explain to me how this video can be 'legally' released to the public without Paris's consent?

    If the company releasing the video does not have model IDs and a model release, how can they legally distibute this tape?

              Well that's what I thought. As a content producer, I am required by law to have copies of the models IDs and a signed model release. How can this be required by me and not the company that's marketing, selling and distributing this tape?

                                                                                                                          I think this is all a conspiracy and they meant for it to turn out this way but here is how it went down. Its all about loop holes. Some dude got a hold of the video and started making money off of it, Rick was pissed he wasnt making any money off the video so he went in search to find someone dumb enough to licsense him the footage for a couple grand. Even though the guy that sold him the footage did not have legal rights to the footage, he gave legal rights to Rick by signing a release. So now if anybody gets fucked, its the guy that sold Rick the footage, after all Rick is not doing anything wrong. It gets tricker, the guy that sold the video turned out to be only 17 but Rick was told he was 18. Now they cant get Rick or the kid that sold the tape.

She did not object to it at the time of filming. Maybe this is a case of it being HER fault for not signing legal hahahahahahahahas stating that no one was to make $$$ off of it or show it publically.

                                                                                                                                      People make money off of people ALL the the time without age release forms. Can you say Girls Gone Wild? It is different in their situation, but all the same. Things done in public can be filmed and rebroadcast even for a fee. If this guy filmed Paris and she knew about it and let him keep the tape, I say it's her fault and has very little recourse.

                                                                                                                                      If I fuck and film a willing woman over the age of 18 and choose to show my friends, there is nothing illegal about it. If I set up shop and charge them $10.00 to see it, why would I need records of her age if I KNOW that she is 18+ for sure? What is going to happen? Some fed is going to knock on my door and want proof? Look up her drivers license with your search warrantes asshole. Come back and see me when you ACTUALLY have something. Kiss and tell isn't against the law as far as I know. These are just thoughts, I am no way trying to state that these are facts. Just my $.02

                                                                                                                                      With the money to be made (or has been made for that matter) it is probably worth a small legal battle that Solomon will most likely win. Thoughts?

                                                                                                                                                                              It's a gray area that relates to reasonable expectations of privacy. Plus, you have some consent - one of the two parties is behind the actual release (unlike Pam & Tommy, Vince and Janine, etc). If you casually fuck people in hotel rooms and video tape it, there's probably not a reasonable expectation that the tape will remain forever private. Paris probably could have tied it up in court with an injunction though, and it makes you wonder why she didn't. But once the Genie is out of the bottle there isn't much point.

                                                                                                                                                                              My guess is she's still going to sue Soloman for big bucks down the line (all profit damages, punitives, etc). These damages will be easier to prove once she subpoenas all his business records.
