Just for shits and giggles and in a slightly different direction: if the model releases are in English but the model speaks only Russian what do you think a court would decide on legality? If the model doesn't know what she's signing, do you think a release will help you?

Damn, Mark, I only just caught something you did. You said "Bella" and "Ella" are sisters and that they have different birthdates. You posted Ella's ID, but Bella's release. The reason the dates on the ids I have vs what you posted are different is that I have Bella's ID and Bella's release. 19.12.1984 birthdate and 30.02.02 release date. Did you do that on purpose?

I told you in our icq conversation, which was posted, that I never used any of these sets until just recently when I was going through the docs. I even went back through all the docs in all the sets I got from you and verified they are ok. I have never had and will never have illegal sets on modelperfect.com or any site for that matter. You know that, so quit trying to discredit me out of revenge. I felt I had to post what I found...That doesn't mean I have anything personal against you. There are just some things I take very seriously.

That is a threat to ALL content producers, and it put the trust of webmasters in their content providers on shaky ground. Flush your head in a toilet or something and get a grip on reality. Just a remark about #5 (2) (Bella). Here is a real mistake because her release was signed on 02/30/2002 but course not on 30/02/2002. I.e. the date on release was in Russian/European format (not in US one). However she still was 17yo according to the dates.

And there's no such thing as Feb 30th...Even on leap years, Feb only has 29 days. That's why I was assuming it was either Feb 28-29 or Mar 1-2.

Well, here is the kicker...there is NO SUCH date. The second month of the year has no day 30......so obviously it is completely wrong no matter how you look at it.

Actually I caugth myself several times messing up dates like that. I mean when I write all dates in one format, but in some cases forgot and use other.

That's why I always use text name of the months in Releases and Agreements. Like that "Jan-09-2003". It can't be misred.

I must confirm that year in Saka release really looks like 2003, not 2002. It's just that lower part of 3 is not visible because of underline. That's the reason why I print the dates when possible or type them.

That's why I like to buy the content from Phoenix66 (I mean photobyag.com). It's not a PR, just a remark ;)

However some other ID's and releases provided by m2mm to ModelsPerfect are really very questionable...

I understand your concerns about wanting to get the docs right, in light of CURRENT 2257 as well as proposed new regulations, you need to be sure you are dealing in content that is legal.

I checked out your site really quickly, and the irony is that you seem to have some good concerns for 2257, but you haven't followed those concerns with your own website.

You have a picture of a girl masturbating (hence the category) and in another category, 2 people engaging in the nasty business. 2257 states that any display or depiction of "sexually explicit" material.. such as masturbation, needs to have 2257 references.

Unless i missed something, you don't have the 2257 compliance information posted on your website, that points to where the records are stored (ie. your company address or the content producers you carry - and a PO box won't suffice and i am not referring to having the model IDs at this point, just the fact that business location needs to be described).

I am pointing this out , not to single you out, but to illustate to all webmasters, that you don't have to wait for the new 2257 regs to come out to worry about 2257 compliance, you should deal with it now, since 2257 has been on the books for around 10 years.

Something as simple as not displaying the company address for where the 2257 info is stored or acquired from, when you show "sexually explicit" material on your webpage, is an obvious "low hanging fruit" company that could be easily picked off by DOJ. Granted, there have been no major busts.. but given limited amount of resources, it would seem easy for them to pick out companies that have failed to comply with sections of 2257 that won't be contestable to Supreme Court (ie. some of the new regulations are very questionable).

For those that produce content, you need to have a signed Model release as well as a copy of the identification documents (ie. passport) AT THE TIME of the shoot.

Each time you shoot a model, you need this info, EVEN IF ITS THE SAME MODEL that you shoot the next week.

You are establishing the photo shoot as the productive work and the required documentation that goes with it to prove proof of age.

So if you had a model that you shoot once a month for a year, then you would end up having 12 diffent pieces of documentation for that photo shoot.

inbetween the time you shot the girl, her hair color could be different, she could have added a new stage name, got married, etc. This information is what gets captured.

So if the photo shoot was 2 years ago and the date of the model release is more recent, there is something very wrong with that.

In what has been presented here, a model could be underage (ie. 17) at time of production and no documents were collected, and then a year later, the model release was signed and the ID shows she is 18 now.. the issue is at the time the images were taken, the girl was underage.. and that's the issue that U.S. law is very specific about, because a child was exploited sexually via the photographs.

Traci Lords is the similar situation that triggered 2257 because she was underaged at the time of production, but when this was found out, she was over 18....

This is all very U.S.-centric.. and many international content producers may not be concerned because in some European countries, 16-17 is legal.

The issue then is for webmaster who are going to use this content (and which probably the models look very young to begin with), will have to be sure that they models are over 18... because young looking models will be the first thing that gets law enforcement attention to start asking the simple question of , where did you get these images from? For which you will need to be able to point them to your source who needs to be available to provide proof of age, otherwise, you, the webmaster with those young looking images, could face jail time.

Content Producers will most likely not give you photo ID (they are not required to and it's a serious security and privacy issue to do so). Some may give you blackened out ID showing birthdate.. but that's not going to hold up in court. If the content producer can't prove the age with credible looking documentation, then the crosshairs could come back to you.

Get your content from credible sources, ones that are looking to be around for the long term, such that in case you get a knock on the door, you can point law enforcement to the content producer, who should be able to easily provide correct documentation to get you off the hook.

This issue of 2257 and obscenity is a time-bomb... be sure to know who you are dealing with when it comes to getting content.
