In fact, even if this was done in an office, and he had a tape recorder in his pocket, and did not tell anyone he was taping it, he would still be breaking the law.

Bottom line - what Duck did was wrong in his employer's eyes and his employer rectified the situation. Duck threw a temper tantrum and took his toys and left the playground. Too bad for him. Duck has no money because he made the decision to live in his writing skill, of which he has none. And the mainstream world hasn't "grabbed" him up for that same reason.

If you are talking criminal court, the State of California would have to be the ones filing charges against him, and again, I would be very surprised if they wasted the courts valuable time with it.
However, now that I think about it, they could just send him a letter, tell him to report to court, and offer him probation. I had something like that happen to me once.
Only difference is that I turned the tables on the person filing the police report, and I had all charges dropped.
Some people don't think ahead very well.
