Aerosol cans and cologne are permitted in cargo (certain toxic aerosols excepted). Lighters are not, plain and simple, whether or not they're loaded. They don't look at the the fuel type and fullness, because they're already banned in cargo. Just because someone else got away with it doesn't mean it's permissable. It sucks, but it's not theft at all, you made a mistake, and they did their job properly. It would be nice if they'd store contraband for the owner for later retrieval, but the logistics and liability involved in such an undertaking would be very costly.
