PornKings.com Fights for Your First Amendment Rights and Triumphs-- Again!
PornKings has always been, and will continue to be, an advocate for Freedom of Speech as well as true believers in our country?s and industry?s First Amendment rights.
For those of you not familiar with the Catherine Bosley case; she was an anchorwoman in Ohio that participated in a wet t-shirt contest during a vacation with her husband in Key West, Florida. During the contest and on three separate occasions she proceeded to strip nude and dance in front of an enthusiastic audience. Obviously loving the attention and excited from the hoots and hollers from the throng of eager observers, many of whom were armed with cameras, Bosley played it up for crowd as well as a videographer capturing the show.
After the videos and photos surfaced on Sexbrat.com, Catherine Bosley and her husband Richard Brown contacted a lawyer who filed suit against Sexbrat.com as well as numerous other companies who showed stills and videos of her performance. Companies such as WildWetT, IllCash, Dream Girls Inc, EZanga.com, Coffinz.com, Cheef.com, Fleshbot.com, MyWay.com, The Bugs Ltd., S.K. Entertainment, Internet Key Inc., Bomis Inc., Slatner.com, DigitalEffex and ExoStream Communications, all buried their collective heads in the sand as Judge Gwin in Ohio slapped a temporary restraining order on everyone from showing the world what Bosley did on vacation. SexBrat.com and SexBrat.com alone appealed this decision in front of the Sixth Circuit Court of Appeals and WON! In their decision the Court of Appeals said, ??This case raises serious constitutional concerns?? There is no way we were going to be active participants in one judge's unconstitutional decision to in any way limit our right to show-and-tell an altogether newsworthy item.
Even more outlandishly this same judge then issued a preliminary injunction which effectively caused the content to once again come down and out of the public's view. The other defendants did absolutely nothing. This struck a moral cord with us. We wanted nothing to do with bad case law which would limit the press and our industry from telling and showing valid newsworthy items. PornKings filed another emergency appeal and today a panel of three judges from the Sixth Circuit Court of Appeals overturned Judge Gwin?s preliminary injunction. PornKings triumphs again!
PornKings lawfully obtained this video from the creator and recognized the significance of this case because of the impact that it could have on our industry. While PornKings realizes that it will be hard to recoup its legal costs from the sale of the story we nonetheless spent the money on the legal battle for the sake of the industry and for future media company?s rights to publish the truth.
During the past few months it has been a battle between PornKings and
Catherine Bosley. PornKings was thrown into the fire along with the other defendants. Rather then take the easy road and do nothing like the other defendants, we decided to stand up for what we felt was right and fight the good fight. In times like these, when our civil liberties are under constant attack, it is a terrific feeling to know that we have done our little part in preserving our (and yours!) constitutional freedoms.
I am happy to say that we have overcome this battle remarkably and have demonstrated that our First Amendment rights do prevail, as well as proving that PornKings does not back down from a fight and will defend our rights and our industry until the bitter end!
