You have very few rights once you try to cross that border...
And here and I thought Canada was something of a free country. Maybe you need to clean her majesties name off of everything up there and try to get down to your individual rights. Your customs is a law enforcement arm and has to follow the law just like the RCMP does the last I heard.
You couldn't 'take it back' but you could demand to stay in its presence while you insisted on a legally signed seizure order by a high level judge.
Now if you were supposed to have some sort of form like the one guy said, oh well, SOMEone messed up then. But still it should take a judge to even enforce that. No, I can most certainly say, once they confiscated your computer, passwords are totally irrelevant. The thing is though, they need people who know what they are doing in order to get based the password protection. Those are not in surplus in Canada.

i was interrogated crossing the border from WA, to BC not too long ago because they asked me what i did, i said "web development" and they asked me directly if i owned any adult sites and i said yes.
they asked me to pull over and go talk to the Customs guys where they were asking enough questions that it was beyond routine. it made me uncomfortable enough that i did not plan on going back soon. i would certainly never cross the border with a notebook after that.Comment

About 5 years ago I was flying from Canada to the states, returning home from Christmas. In my carry-on bag, I had a toaster oven someone gave to me. We're talking about a 9"x12"x14" toaster oven, not some mini-toaster thing... a full-sized toaster oven. A lady working for U.S. customs looked in my bag, shuffled a few things around, and then as she closed my bag she said "Don't worry, you don't have to turn on your computer." I had no computer; she was referring to the toaster oven!
So hopefully the Canadian customs agents won't try to jam a slice of bread into your laptop before they turn it on

Unless you look like bin laden or have CP on your system they dont care.. or they shouldnt - for anyone else who joined me going to the usa from canada the most they ever did was ask you to turn your system on to prove it works.

So the customs officer saw LEGAL adult material and decided to seize the machine pending what he called "classification"
I'm left thinking that's total bullshit- all files he looked at were legal and within canadian obsenity laws. but because they were adult he seized them. Personally I think that shows ignorance and a personal prejustice against adult on behalf of that customs agent and I will be persuing a complaint against that officer. Canada Border Services Agency is the most powerful law enforcement agency in Canada when it comes to search and/or seizure..
Heck, if they suspect you are transporting contraband across the border, they can kick the door in on your property, that might be 1000 miles away from the border, and do a search w/o warrant.. try to get the RCMP, or any other police force in Canada to do that.. no way, it'd be thrown out of court immediately.
I hope for your sake Sleazy there wasn't anything on the notebook that might just be deemed "obscene material" .. if so, its a goner..
As for why did they search your laptop.. who knows.. could have been a smart ass response to a question, you seemed nervous, etc..
Did you have the identifcation card? As mentioned above that proves it was not a brand new laptop, etc. etc. That may have helped in avoiding the search..
