Hey I?m new to GFY?.and I know its not meant for legal advice, but I would appreciate any sound opinions, or similar experience. So my question goes something like this?.
I received a c&d for a site of mine that does business for apartments nationwide. The company issuing the c&d is an apartment locating firm that?s bound to one city but has the exact same name of my company/website/domain. There is no doubt, there will be confusion down the road in that city. They have been in business for a many number of years and are trying to take/shutdown my domain pleading the use of commerce on a first come first serve basis. The domain I have is an exact match to their company name?they have always owned a modified version of the domain. When I registered the domain, it was available to the general public?didn?t snap or force otherwise. Some think this is an open and shut case for them and some think they don?t have a leg to stand on. What say you?
