Normally it would be. However personal polaroids of your days as an altar boy are exempt.
I believe it can't be prosecuted as it falls under constitutional protection. Separation of church and state.
FOOTNOTE: I don't have any clue who dawgy is and this was not meant as a personal attack on him/her. But the door was just wide open, I could not resist walking through it.
BTW, I also believe the situation re: ASACP/LIGHTSPEED/SEX.COM is wrong. It is probably even actionable.
