    President Bush takes down HowardStern.com

Turned into a political website, www.HowardStern.com, has been shut down by many ISPs. He put anti Bush, pro Kerry links on the site and many will not link it. Freedom of speech is GONE.

    Dark..I hope I beat you to it....lol

Take the comma out of the URL. Try link checking next time.

While I don't think the government has done anything to censor it, as the site becomes more political, it will be subject to regulation by the federal election commission. You can't just put up web sites and state your political view in the US, unless it costs you under a couple hundred bucks or something. You need to file paperwork with the federal election commission. It's the same reason you can't take out an ad in the paper or run a TV commercial espousing your political viewpoint.

We have freedom of speech, as in we can walk down the street and say "hey, I don't like Bush," or write non-obscene political statements on a piece of sign and carry it in certain government-approved areas, but when it costs money to broadcast our opinions to several people at once, that freedom has been elminated through "campaign finance reform." As a webmaster, be advised that you can get in deep shit if you promote any political causes on your sites and fail to file the proper paperwork. Ironically, last election Bush was railing against an anti-Bush web site, which until then had been within the allowable spending limits, but once he talked about it in the media, it got bombarded with traffic, and drove up the bandwidth costs, which caused it to be in violation of FEC spending limits. I think they initiated an investigation, but the PR backlash caused the complaint to be withdrawn.

If you assumed I was defending the legislation regulating speech, or Bush's position on the matter, I was not. If you think I'm simply misinformed about the Federal Election Campaign Act, it's possible, but the last I heard:

Prohibited contributions and expenditures: The law prohibits corporations, labor organizations, federal government contractors and foreign nationals from making any contributions and expenditures to influence federal elections.[ 11 ] It also prohibits contributions to federal elections in another person's name and prohibits cash contributions in federal elections of more than $100.

Identification requirements: While "independent expenditures" by individuals or groups are unrestricted, where any expenditure finances communications expressly advocating the election or defeat of a clearly identified candidate or soliciting contributions through any general public political advertising, the communication must identify the party responsible by name and indicate whether or not it is authorized by the campaign.
                                              (Source: http://www.cdt.org/speech/political/financereport.shtml)

Is howardstern.com expressly advocating the defeat of George W. Bush? It's debatable, and I'm sure Stern's attorneys are carefully tiptoeing around the issue. Look on the site and there's a section of "Friggin Bush" links, all critical of Bush, and Stern says "Vote out every Republican you can find," but that assiduously avoids advocating the defeat of a "clearly identified candidate." I don't listen to his show, so I don't know, but has he explicitly advocated Bush's defeat? Or is he just criticizing him and his positions?

Is howardstern.com expressly advocating the defeat of George W. Bush? It's debatable, and I'm sure Stern's attorneys are carefully tiptoeing around the issue. Look on the site and there's a section of "Friggin Bush" links, all critical of Bush, and Stern says "Vote out every Republican you can find," but that assiduously avoids advocating the defeat of a "clearly identified candidate." I don't listen to his show, so I don't know, but has he explicitly advocated Bush's defeat? Or is he just criticizing him and his positions?

sorry, but you are wrong. he can put up whatever he wants, and it will have nothing to do with campaign finance reform.

He can say whatever he wants, as long as it's not paid-for commercial speech - talk shows like that are presumably profitable, or try to be profitable, so they're not spending money to espouse their political views. If they weren't profitable, then the person or group providing funding to broadcast the shows would need to comply with FEC regulations. (Either tiptoeing around the regulations, or registering and keeping within spending limits).

The web is uncharted territory. The law certainly suggests that if a person or group are spending money to finance a web site of the nature described in FECA (above), then they fall under FEC regulation as well. So far the public and politicians asking that the measures not be enforced with regards to the web, as it's still an area in its formative stages, but the law is still on the books. There are plenty of defenses possible too. But I'm not sure why you think it has nothing to do with campaign finance reform. Have you read any case law or legal opinions on the issue? Having had SS investigations concerning my political domains, I try to keep on top of these things.

Can't Howard Stern have a personal website where he can say whatever he wants like every other citizen of the United States? Legally, however, individuals as well as companies and other groups fall under campaign finance laws. A private citizen can buy ad space if it's under $100, or for more if it doesn't advocate election or defeat of a particular candidate. It doesn't matter whether you're being paid by the parties or not. That's part of what the campaign finance reform debate has been about - a loophole existed such that you couldn't give much to a candidate, but you could spend billions of dollars running your own ads for a candidate, or against their component. Not much has changed, but new loopholes had to be found to achieve the same thing.
