My friend FUCKED up. Should he tell his lawyer?

Alright, my friend (more like an aquaintance) stole about $20,000 worth of jewleries from his workplace. They did an investigation and they say he did it, and they think he was selling them on ebay

So they arrested him 3 days ago. He called me for advice, told me that he did it. He hasent told his lawyer though. Should he come totally clean to the lawyer? If so, can he still put in a not guilty plea, or will the lawyer be obligated to not put in a not guilty if he knows the guy is guilty? I need some clarifications on this for anyone who would know. I can't believe how stupid he was to do this

Tell the lawyer. He is required by law to work in the client's best interests.

well, thats what I told him, but he is not sure...this is the first time he has been in trouble with the law, so he is clueless as what to do. He is just afraid that the lawyer will not represent him well if the lawyer knows he is guilty.

Also, this is supposedly a felony rom what the lawyer told him, but its his first tim, he doesnt have a record. He said its a minumum 3 year sentence. How long do you think he will do? Any ideas anyone?

Tell his lawyer. The guy will be out on probation in no time.

Edit: By the way, fighting to trial is not a good idea. If the company says they think he did it it's more like THEY KNOW HE DID IT. They're just saving the hardball for court if they must.

Plea bargain, lesser sentence, most likely probation. It's the American way.

In some states he would have done better killing someone, and gotten off lighter.

Problem is now you're dealing with insurance companies and corprations. They don't stop. This isn't about loss of life, this is about 20k worth of kewels. And no doubt, they will claim he stole more than that for insurance purposes.

If they said 3 years, he may get off with 1, but hes goinig to jail no matter what.

Unless his lawyer is gtood and really pulls shit together, I dont see him getting off totally.

                            This is serious theft.

he didnt jack a bicycle, he pissed off some major players with stealing that shit. This is some Romancing The Stone shit man, people dont like when people steal 20k worth of jewels. To most, thats worth more than someones life.

This is only my opinion but, it was pretty dumb all around, let us know what happens.

This felony is going to haunt him for awhile.

I think tell the lawyer too, but just to be sure, he should ask his attorney hypoethetically what the tradeoffs are if a guilty client confesses to their attorney vs. withholds confession.

By the way, I hope he didn't confess to you on the phone.

Non-violent felony and no record. Think about it.

If he doesn't tell his lawyer he's a moron.

Yes, first time offenders usually get it easier, does depend on location though. But here's the deal, whether he was really guilty or not if he decided to fight it all the way and was found guilty AFTER a trial they will throw the book at him. Our court system likes sliding people in and out and taking their money. Waste their time they'll waste yours.

Fletch is correct. Once an insurance company gets wind that you have robbed them, they do not stop for anything. I was just reading about a guy that got a year for scamming one for about $900.

BTW... posting about his confession on a public board may not be the smartest move.

i know 21 year olds with 25 + to go man, stealing jewelry isnt much.

Tell the lawyer and do five months at 'club fed'...

No way he'll see the dim lights of a 'pen' over this.

I have lawyer friends and family that work with TONS of insurance cases, and this is absolutely correct.

they KNOW he did it, and will go as far as possible with it. They must clearly have proof too, and it took them awehle to go through hidden camera tape.

Once they have him, they will NOT STOP.

Bext find a way to keep it out of court, but insurance companies dont give a fuck about sttling, they have nothing to gain. Again, we're not talking about two parties being involved and suing each other. Insurance companies are like casinos, out to get what is theirs, and whats theirs, is "money."

He should ask his lawyer if he [the lawyer] wants to know if he did it.

Answer truthfully, if the lawyer wants to know.

If the lawyer does not want to know, keep his mouth shut.

Big corporations don't like having their name all over the place tied to crime. if he can return some of the stuff and work a deal he could get oof real light. restitution and community service. Recovering the stuff helps. But obviously the lawyer would need to know if he could recover some of the stuff.

he should tell his lawyer everything.. there's attorney-client priveledges so the lawyer wont spill the beans, plus the lawyer wants to win the case.

Restitution is supposed to go to the party that was wronged but sometimes it doesn't make it there. He'll most likely get restitution whether he received a probation sentence or jail time. I don't know where you are from but stealing from a store here $200 or $20,000 first offender would be out on 2 years probation even with a public defendant. Research some local plea bargains and see what's up there.
