    Misleading Domains Gets 2 1/2 Years For John Z - Ouch that's gonna hurt!

    Man Gets Prison for Trick Web Names

    NEW YORK -- A man was sentenced Thursday to 2 1/2 years in prison for registering misleading domain names on the Internet that guided children searching for popular sites like Disneyland to pornography instead.

    John Zuccarini, 56, arrested in September in Hollywood, Fla., sobbed and apologized before he was sentenced in federal court.

    Zuccarini pleaded guilty Dec. 10, admitting he capitalized on the tendency of youngsters to misspell, fooling them into finding sites that advertise for pornography, among other things.

    The misspelled names led Internet surfers to advertising sites that paid Zuccarini for each user who viewed them. The government said he made up to $1 million a year from the scheme.

    Prosecutors say the charges and plea were the first brought under a provision of the federal Amber Alert law, which makes it a crime to use a misleading Web address to draw children to pornography.

    Last year, Zuccarini was ordered to stop the scheme after the Federal Trade Commission sued him for registering misspelled variations of sites for the Backstreet Boys, Victoria's Secret and The Wall Street Journal.

                      only 2.5years? Do us prisoners have a chanche to be released earlier (like in belgium they are free after 1/3 of the sentence if they behave in jail)?

For example, he registered 15 variations of the popular children's cartoon site, www.cartoonnetwork.com, and 41 variations on the name of teen pop star, Britney Spears. Surfers looking for a site who misspell its Web address or invert a term - using cartoonjoe.com, for example, rather than joecartoon.com - are taken to the defendant's sites. They then are bombarded with a rapid series of windows displaying ads for goods and services ranging from Internet gambling to pornography. An FTC investigator entered one of the defendant's copycat domain names, annakurnikova.com , and 29 browser windows opened automatically. In some cases, the legitimate site to which the consumer was attempting to go is also launched, so that consumers may think the hailstorm of ads to which they are being exposed is from a legitimate Web site.

                                                          Once consumers are taken to one of the defendant's sites, it is very difficult for them to exit. In a move called "mousetrapping," special programming code at the sites obstructs surfers' ability to close their browser or go back to the previous page. Clicks on the "close" or "back" buttons cause new windows to open. "After one FTC staff member closed out of 32 separate windows, leaving just two windows on the task bar, he selected the "back" button, only to watch as the same seven windows that initiated the blitz erupted on his screen, and the cybertrap began anew," according to papers filed with the court.

                                                          Finally, the defendant's sites contained a "stealth" feature that was hidden under the task bar, making it invisible to consumers. ". . . The stealth page contains no content. Instead, its sole function is to act as a timer, periodically launching additional pages of advertisements, without any action by consumers. Thus, even as consumers struggle to escape defendant's multi-window mousetrapping scheme, more windows launch automatically," FTC documents say.

                                                          The FTC estimates that the defendant earns between $800,000 and $1 million annually from his scheme, charging advertisers whose banner ads and affiliate programs are included on his Web sites. According to documents filed by the FTC, "Defendant has been sued no fewer than 63 times in the last two years, including seven federal district court cases . . . and 56 arbitration proceedings. . . Despite losing 53 suits and having almost 200 of his domain names transferred to the rightful trademark owner, celebrity, or company, defendant continues his practice of diverting and trapping consumers for his personal profit."

I wonder if they dropped those charges in exchange for his guilty plea on the domain charge. It also doesn't mention a lawsuit he lost from the FTC a couple years ago...he was fined a few million dollars and ordered to stop doing what he was doing, but he just skipped town and ignored the ruling, I think living between a Carribean hideaway and a hotel in Floriday.

                                                                                                                                                                                  The law is a short paragraph. It just says misleading domain name and I suppose that is open to intepretation...but I think the gist of it is that it is blatantly misleading names, but still by keeping the law broad, they have the ability to go after anyone although some names are probably much harder to prosecute than others...

                                                                                                                                                                                              It's like the obscenity laws, it's open to interpretation but will be darn hard to prosecute for tame variations. For example, think of a teen doing homework for a project, are they going to visit something like 'cuteteens' or 'prettyteens'? Probably not, unless the variation is of a site that already exists as a brand for some other website in which case you may get forewarned by the original site before the government steps in, I think there is also the question of intent. This guy who was prosecuted had thousands of domains and his knew very well what was going on. It can't hurt to have a disclaimer page, the idea according this article is 'tricked'. I don't think its a 'trick' if there is a no-nudity disclaimer that says 'This is an adult site with xxx content, you are warned'...
