    Kudos is a common word and the owner of the trademark "kudos" basically steals the domain

          - the Respondents registered the Domain Name in bad faith as they had active knowledge of the Complainants? rights when registering the Domain Name. In 2001, the Respondents were using a figurative mark on their website under the Domain Name that was virtually identical to a device owned by Kudos Information Limited since 1996 (registration no. 2116056).
          If that's true, then they deserved to have the domain taken away.
          I post on GFY so that when people ask me what I do,
          I can tell them that I work with the mentally retarded.

              Strange things happen when domain owners put up no defence.

              One of the worst cases was over Diablo.com -- in that case, there was the situation where NSI had changed the creation date of hundreds of thousands of domains in the WHOIS, and the complainant then argued that the domain was reg'd AFTER the TM. Ugh. (NSI later fixed all the creation dates, but since the domain owner didn't respond, the name was lost as the panel didn't know the truth)

                  Why? They registered kudos.com in 1994! Years before the trademark existed.
