The only time dimissal has been upheld by the Federal courts is when "an employee's political activism compromised [the business'] credibility... dismissal was necessary to defend its reputation for impartiality." This has only applied to newspapers so far.
The fact the business handed out pro-Bush pamphlets shows the company had a defined politcal leaning. Ergo, the dismissal was a violation of the woman's right to free speech.
