    Is it legal to used internet found content for AVS?

    Hi,

    I am planning to make a nice AVS site, and would like to know if it is legal to use pictures and movies you found on the internet. I will also use sponsor content, but since lots of that of "faked" (acted), I would also like to throw in some really amateur content, like pictures taken on the street, or other stuff you can find on Kazaa etc.
    Those pictures aren't made by me, and most people on the pictures don't even know they're on. Is it legal to use that kind of content (and make money off it placing it on my AVS site?)

          Why do you think you would have the right to use content you haven't paid for? Do you have model releases? Do you have documents that prove the models are over 18 in compliance with USSC 18 section 2256 and 2257?

          NO!

          Don't be cheap. Content costs next to nothing, take a few dollars out of your pocket and INVEST IN YOUR BUSINESS.

          If you can't do that, don't bother.

          Let me guess, you are planning to put the site on geocities and use cjb.net for redirection?

                  and no if you don't have the proper paper work for that content it's illegal. so you can't use it

                                      I suggest you look into some content providers.. There's no such thing as a free ride, and those pictures all belong to someone. If you don't want to have a fine of $100,000 per image per use, or 5 yeras in jail, I suggest you BUY your pictures.

                                          Ever here of copyright infringement?
                                          What about an image you "found" where the person in the image has the legal right to sue your ass off if you post it on the net? An image that person did not sign a release for. You are just as liable as the original publisher of it.

                                              Woops, believe something got mistaken! I am not in for the cheap deal, I will invest money in this site and it will be hosted on a normal hosting account. I am not into stealing content or something like that!
                                              It is just that for the topic I want there are lots of over-acted pictures available, while I am more into the spontanious kind of pictures. Like for excample, I got a movie of a really nice girl (drunk however), walking around in her red thong showing it to everyone, filmed by a party mate or someone else in the crows. This is clearly not acted, and great to see. My question is, if it is legal to put such movies on my site, since I don't even have a name of this girl.

                                              But I understand there has to be a document for every picture available. Too bad. Site will still be built, but my kind of topic would be hard to find in a picture set (because most of the pictures are over-acted like said)

                                                          If you don't own the ? or have a license then you cannot use the images.
                                                          Public domain images applies to content shot more than 50 years after the death of the ? owner ( this has been extended now to 75 years recently ) there are a few exception to this rule, but by using stuff of Kazaa you risk possible legal action. Ignorance of the law is no justification especially is you are making money from stolen content.

                                                                              If you are filming "party" content yourself you'll need a model release for everyone unless such footage is of a public event (festival, Mardi Gras, Spring Break, etc.). Don't use anyone's image as marketing without their consent.

                                                                              Edit: That doesn't mean you can use someone else's public films, only your own films you shot at the same event... otherwise use content from a sponsor (click the post-it note in my sig for some free content), other option being leasing or buying content from producers. If you're looking to buy content, post what you are looking for and I'm sure someone here will have it.

                                                                                                  you can use sponsor content, content you purchase, or content you or a friend shoots as long as you have model releases and proof of age.

                                                                                                  It is not a good idea to shoot drunk chicks, as they can later sober up and decide they did not want to be splattered all over the Internet, and the contract you had with them would likely be judged to be void.

I better prefer to get OWNED here than to make a final trip to the states. Don't see why you and some other guys need to jump all over me. I highly respect the GFY webmasters as being very educated in this very law, and since I want things to be sure I ask here. It's that simple, not because I'm a total retard (like you treat me). If you were standing face to face with me you might even like me and my ideas, so don't jump to conclusions that fast would you. You would be suprised who you bashed now when I can really evolve my ideas in the future (when more money comes along)

                                                                                                                  If you aren't willing to put the money into investing in a lawyer to find out the laws where the MOST IMPORTANT aspect of your website is concerned (content), maybe consider another industry? If you're goign to host in the US, find out the laws in the US.

                                                                                                                                                              If someone used our photos with out paid for permission WE"D SUE THE SHIT OUT OF THEM If you really want those photos why not just ask them? They might say ok. Why take the chance that you snag an underage photo, then youd be fucked. Or if it was exclusive..Stealing content is wrong. You never know who you are stealing from and they may just deal with it differently then calling the police or going to court. People pay alot of money for photos/videos and some have families to support. and If you want to work in the industry then work like everyone else! I am trying to help you, hope that you take my advice. I'd suggest posting exactly what you need in a new thread I guarantee you will get many offers from photographers. Good luck

                                                                                                                                                                          But I still don't know why people get so angry from this simple question. It was just meant as confirmation, I needed to be sure of something. I do that with more things, it just makes sure I'm not putting money in something illegal. I mean, I will invest in design, content, hosting and promotion, I take this serious and I don't mind asking "stupid" questions, as long as I know I'm on the right way. Okey, maybe I'll laugh on my own in the near future when I am reading back my past questions, and are also thinking that I sounded like a complete n00b. But I than know I am operating as legal as I can in this industry. It's better to sound stupid when you start, than ending up in jail and than getting smart (philosofic moment :D)
