                                                              to answer your question, the prosecution presented their evidence to the grand jury, the grand jury decided based upon this that it could go to trial. at a grand jury hearing, my understanding the defendent's position is not even presented or present (though apparently in Kobe's trial that's not the case, can't reconcile the differences).

                                                              So for those three years, the defense was able to better understand how and why the police got their info. They presented to the judge that this evidence should not be allowed. The judge agreed this evidence shouldn't be allowed, which was basically all the evidence. So at this point, having three years elapse, the prosecution had to drop their case due to lack of evidence.

                                                                  With the (intended) nasty side-effect of screwing this guy's business and life up by using the law as a bludgeon to beat down someone who doesn't pray to the same god, or thinks that 'down there' isn't a dirty place to be avoided.

                                                                  The really obnoxious part of it all is that it's fairly obvious someone was doing this to make this guy's life miserable, but because of back-scratching and plausable deniability nothing will ever be done about it. Something that leaves normal people standing, but melts the skin off the ultraconservative, the bigotted, and the ignorant-and-proud types. Oh, and anyone who keeps a rusted out ford up on blocks out in the front yard. Or maybe a virus that only attacks people after they watch more than 40 hours of nascar in a month.
