On that note... are peoples names trademarked or protected?
ie if someone were to use...
"The Bill Gates of plumbing!"
"The Donald Trump of Swimming pools"
That reminds me of a couple commonly used examples...
The cadillac of ___________

I've heard "the cadillac of ____" in informal speech and articles, but it would be vulnerable if used as the basis of an ad campaign, and definitely as a company name.
Napster is still kicking. They went bankrupt, and were bought by some recording company, who resurrected the brand and site a few months ago. It's exactly like the old Napster. Except that all the songs come from that recording company. And there's only about 1/500th of the songs available. And the software is completely different. And you have to pay for every song. But otherwise it's identical!
