Even by the old regs you should have been including a 2257 link in galleries all along. Nobody did this, but if they had then nobody would be worrying about updating and getting banned.
....But TGP's are at least partly to blame for people not having 2257 links.
They don't scan the gallery HTML for a link containing the word "2257" to exempt that link from the link count. So it's encouraged every gallery maker to break the law for years.
The bottom line though is that it's the gallery maker who didn't include the link by their own choice. So no, TGP's should not have to offer a grace period to change galleries.
