Small interjection on the facts.... RadioIO is a net radio station, that shouldn't have been targeted anyways since there is no user selections.. .Acacia has since not bothered with them.
The "three-quarters of a percent" was the rate for net radio type stations...which was early on and since abandoned.
The latest webmaster contract:

Lists 4% of gross for those making under $1M... over $1M is a different rate structure not disclosed.
That said, i believe that other companies received sweetheart deals... we'll see how the numbers don't add up when the Q4 Acacia results are posted.

Acacia is currently busy with the current 10 defendants and the recently filed 8 lawsuits (back in december).
I am guessing they won't be filing any more lawsuits, with the exception of trying to get their 2 class action lawsuits approved.
This is the calm before the storm.... and i am in the process of writing a Pre-Markman Hearing Primer article to get people up to speed as we approach the Feb 6th date.

It's not quite that cut and dry, because there's still the issue of any other sponsors that you send traffic to, and/or any past "infringement" on your part.
If you are being sued by Acacia, speak to an attorney, and work with them to determine the best possible course of action given the details of your own situation. I'm not in a position to give any advice where beyond that where Acacia is concerned, nor should you accept any advice from anyone that is not an attorney. It is a complicated situation, and it calls for counsel from a real expert.

The more interesting part of my article is the following:
The implications of this outcome could mean that the defendants and potentially anyone who uses digital audio/video over the internet, and who has not licensed the patent, would not be infringing on the patent.
The companies that already licensed the patent would have to continue to pay licensing fees. These companies would have a difficult time to break their contract, because they voluntarily agreed to the definitions that Acacia used in the license.
So what do you think would be the implications of the defendants getting a non-infringement verdict, but don't invalidate the patent?
Will current licensees have to continue to pay the license on renewal, or do you think they won't have to pay?

It will take me a few days to read that and find all the loop holes, but I can see one that is glaringly obvious - the patent never refers to internet transmission - only to metropolitan area network and local area network transmission. I think the most obvious reason for that is that the internet wasn't deemed a viable medium for media transfer when the patent was introduced in 1991.
I don't see anywhere that it redefines that internet transmission is also covered by the patent.Comment

Beyond that, only a judge can decide how much money Acacia gets for their bogus patent. Acacia can demand ten million dollars from everyone, but only a judge or jury actually has the power to make anyone pay a penny.
It's very disappointing that more people aren't fighting on principle.
