        acacias claims apparently have enough merit that the BIG names are bending over. that leads me to believe that its just a matter of time til all the medium and small guys cave in. acacia just hasnt gotten around to them yet.

        dont accuse me of defending them because i am NOT.

        i think its awful that those fuckheads are now making money off the hard work of other people.

        my ONLY assertion again is that its fucking inevitable.

              i think part of the problem is alot of these mid to big size programs like topbucks probably arent as well off as we think. All the visa crap, too much free porn, much tighter profit margins.

              The guys that could have really fought it are hustler, who easily has more money than acacia. But they rather take the sweetheart and watch their competition fucked with.

                          Well Acacia is attempting to set themselves up to take on the bigger boys.. but I'll tell you, with Universities getting involved and whatnot, I would be stunned if Microsoft allows this whole patent thing to go very far.. especially since they have software that essentially puts them in the position of contributory infringement. Things are going to hit the fan sooner than everyone thinks with Acacia.. Sorry to see companies are still falling for their bullshit.

It simply means that was a business decision they made. The only REAL precidents would be if Acacia actually had a legitimate court win, which they have not.

                                    precedent doesn't really come into this - it's patent law. one single piece of prior art invalidates the entire patent.

                                    remember their v-chip patent - EVERY tv manufacturer rolled over till there were three left. and those three invalidated the entire patent.

                                    topbucks has the right to make their own business decisions, but i wish they would have at least held out on signing till after the next quarterly stock report. as it is, they are validating acacia in the eyes of stockholders and other companies being told to license.

                                      The thing people keep forgeting is what are all these companies going to do when the next patent comes up, then the next one and then another one. The problem is lawyers are giving advice based on this patent like its the only one out there thats going to come after web businesses and its not. If you dont think others with patents arent sitting watching this play out your crazyl.

They are too broad and there is absolutely nothing they can do about it. They don't have their patents here, never have, and never could even if they wanted to.

                                                                The way i see it, in the bigger picture, Acacia's DMT patent will be found to be invalid... from the current 10 defendants waiting for their first day in court on Feb 6th... or to the alternate reality that some believe, that the defendants all settle.. but then a large mainstream company like M$ or a university will invalidate the patent.

                                                                Whichever reality you choose, the outcome will be the same... that the patent claims will be found to be invalid.

                                                                Looking at how this relates to the adult industry.. there is going to be a shift in the definition of what an "industry leader" means.

                                                                Rather than meaning a company who's business practices set an example to all and look to act in the best interests of the adult industry (including competitors), rather than just for themselves to an "industry leader" as someone who is making lots of money by having market dominance.

                                                                All of the smaller players should look at all of this as being competitive roadblocks..... the larger companies will get larger, and the smaller companies will be consolidated, rolled up, or become unprofitable.

                                                                Maybe people were put into a false sense of community with the various message boards where webmasters congregated to talk about business and other issues.

                                                                What is becoming apparent is that it's all about biz...and there is no community, and there is no "industry leaders" in the old sense of the definition.

                                                                Welcome to the new economy within the Adult Industry...times are-a-changin'.

                                                                What's the solution? Smaller companies could band together with larger companies that do see a need to watch after industry-wide issues by becoming members of the IMPA.

                                                                    I think many of these companies haven't been involved with heavy duty lawsuits and are just figuring lets not chance it.

                                                                    Most lawsuits are settled out of court. In fact, I don't recall the latest figure, but its over 90%. Most times you can settle for pennies on the dollars. Even if you do go to court you can appeal and stretch the damn thing out for years using various legal maneuvers and tactics. Even if after all that they win then they have to collect which is another process.

                                                                    I had one idiot that sued me along with a major wall st. firm over a deal that the wall st. firm fucked up and everyone involved in any way got brought into it. The guy wanted $90,000 in his demands from our end of the deal. Never even had to go to court and one of my corporate attornys settled it for only $5K. The wall st. firm he was trying to play games with for millions ended up settling for a mere $50K. End of story.

                                                                          yea I agree with you as I think it's all BS but as someone that knows how fast a business can go under because of BS lawsuits.. In America you have to prove you arn't the one in violation, which can be a very costly venture..

                                                                          But in all honestly no matter how big the company is, no one except the owners and the book keepers know if they have the money to fight. At least Top Bucks tried to fight fo awhile, but only they know when enough is enough.

                                                                          I know personally I would have to leave this biz if they came after me, I don't have the money to fight them and I'm too hardheaded to sign a deal with the fuckers... so I would have to shut down my server untill it's settled.

                                                                            It all comes down to dollars and cents - not b.s. posts on a webmaster board (expecially by people that the licensing doesn't effect anyway)

                                                                            I think it's ridiculous some of the crap that's been said about people that decided to stay in business, and allow you all to stay in business as affiliates by signing this agreement, whether they agree to it or not. one of the reasons they are successful companies is because they make wise business decisions. Not that the hold outs aren't 1. successful or 2. wise. It's a matter of what you're ready to go through and spend - it's not just money, it's stress, time, AND money. The time and the stress affect not just your business life, but your family life too. I think the group fighting the patent is even more admirable for having the gumption to go through the whole procedure.

                                                                            I think to save your child RIGHT NOW, you'll pay blackmail even though it isn't 'right' and THEN go after the kidnapper.

                                                                                              As far as I know you can't force someone to pay royalties on a patent that doesn't exist. If the patent is invalidated, Acacia won't be able to collect on it any longer, will they? Nor will they have grounds to sue anyone else, either. As far as recovering the money these companies have paid out to date, I have no idea, but I'm sure they will be SOL.

                                                                                                      thats irrelevant, what IS relevant is that no one is fighting it in court. they are SIGNING. that means several things:


                                                                                                      #1 it encourages others to do so

                                                                                                      #2 it lends the whole cluster fuck credibilty it might not have otherwise.

                                                                                                      #3 it will give acacia PLENTY of fucking ammo when and if it actually DOES get litigated

                                                                                                      #4 it puts money in acacias pocket, and guess how theyll USE IT?

                                                                                                      #5 and perhaps most importantly, as ive mentioned, its giving the impression that the claims have merit in the first place.
