CAN-SPAM law...what a JOKE!

Well I guess this CAN-SPAM law is gonna be abused like crazy. The first day it is considered a law we get a call from somebody at our offices threatening lawsuits. Seems like they were just subscribing to our ezines WAITING for this DAY.

What a joke this is all gonna be. FIrst day and already 1 threatened lawsuit. Guess my lawyers will be busy this new year as this CAN-SPAM law is surely gonna be the result of many frievlous lawsuits trying to cash in on the new law and what better companies to go after than porn companies.

To all the people who plan to sue me, HAPPY FUCKEN NEW YEAR TO YOU TOO ASSHOLES AND GFY!

it's sad but a lot of people have found it's easier to sue and make money rather than actually work for it. Our civil justice system in this country needs a huge overhaul.

Yep..gonna meet with my lawyer to go over my options on all this. All in all this really SUCKS.

That guy who called me must have been one LONELY lawyer just waiting for the 1st of the new year to come to make some calls haha

See the problem is that any jerkoff and his lawyer can pay the filing fee ans serve you and such...... now no matter how stupid the lawsuit is and youknow has no merit you still have to pay your lawyer to defend it. So there goes a few g's and after some postponements and motions and other shit they do its afew months and nothing got settled. Also the stress and the bullshit and such..... As you can see I hate lawyers with passion

There is a 120 day grace period for one thing. For another I thought they put the right to sue only in the hands of the government?

Naw no need to rough him up, he is helpless and after reading over the law some more I do believe we have 120 day grace period AND as I read in one article:

"Who would enforce these provisions? The federal law does not allow individual e-mail users to sue spammers. Instead, the Federal Trade Commission (FTC), other federal agencies, Internet Service Providers , and state attorneys general can sue on behalf of Internet users. "

So he personalyl can not sue me BUT I do not think I want to be on a watch list of the FTC's or any other federal agency

This is true. Even though you know you did nothing wrong, you have to waste time and resources to fight it multiplied by the number of sue-happy morons that come forward.

Hopefully frivolous lawsuits such as this will get thrown out quickly to discourage further abuse of the CAN-SPAM law. Wishful thinking I know

What's FUCKED about that law is that it authorizes SO MANY people to sue you for so many sections in the law. Its like WWF Free For All.

The sad part is the law requires accurate header and subject line info. If mailers do this, then they get blocked, filtered, ignored. Fucked if you do... Fucked if you don't...
