They probably arent sure exactly what they are going to do yet. First of all if bush doesnt win in november asshat is history, and they havent even enforced the current 2257 regs. Second, this secondary producer stuff has already been basically invalidated (i think the sundance case?) and asshat is just throwing out more of the same here, so there is substantial reason to think that this new stuff wouldnt be supported in the courts anyway. On the other hand, nobody wants to be one of the few that might get prosecuted for this either, so i suspect they really dont quite know what to do yet.
