If you own the page with the content, and it's on your server, you are considered a co-producer, so therefore you must hold digital copies.
I'm staying in the TGP area..we arn't considered co-producers for the galleries we list unless they are ours

from what i understand, the publisher 2nd from the content provider must supply records. So providers must supply digital copies to anyone who buys their content.Originally posted by alexg

I know ZipContent.com is already sending digital records with 90% of their packages that are bought.
If the gallery builder is using sponsored content, they are considered a 3rd party user.... sponsor being second(must hold recrods), and provider being the first.
So i'm not sure if the gallery builder needs the records becasue it's sponsored content.
...i'm only sure for about 80% of this.....so don't read this post thinking i'm 100% correct..i'm just spitting out what i've read and heard.Comment

If you host it, YOU are the secondary-producer. No difference if a sponsor says "here download it free" or not.
Applies to "sexually-explicit" banners obviously as well.
If its a HOSTED sponsor gallery, well thats entirely different.
But I'm no lawyer.
