Bottom line is: The reg will go into effect on 8/24. Then we have 30 days to comply, so that's 9/24. If on 11/3 Bush loses the election and becomes a lame duck -- Asshat will probably take a few parting shots at the industry before he goes back to losing elections to dead men. Then, maybe, the country will return to some sanity.
I think everyone is worrying for nothing. TGP sites will not die because of the law and porn will live on no matter what regulations the AG dishes out. Once these regulations are law businesses will spring up that will help webmaster comply. That's how the business world works. When there is a need to be filled then businesses will try to fill that need. When Content Providers and Sponsors start to comply them the little people will find it easier.
With regards to people trying to move shit overseas. This will not work. You live in the US; therefore, you are bounded to the law.
People who live outside of the US will find it a little easier becuase we are not bounded by US law. For example, the only laws I know about in Canada are the Obscenity and Child Porn Laws. Canada's CP laws are alot tougher then US laws.
Basically, everything will take shape when the time gets closer. Sit tight. Relax.

NOW.
It's not a problem really. All you need to do is add some new information in your records. Simple.
The problem is -- I've bought licensed legal content many a time from legit providers -- never once have they offered me the models ID...never mind two of them. From people I've talked to on the production side -- they say there is no way they can do that for privacy reasons.
Originally posted by Greg B I ain't worried about it. That's why I use original toons. Don't have to fill out forms, pay for lunch, grant raises and listen to complaints.
Low overhead lifestyle.
The way Ashfuck is going - I bet you will need a 2257 for the drawings soon. LOL
SexEducation.com will continue to host it's domains and servers in the United States BECAUSE they have the strictest laws anywhere in the world with regards to protecting the "models/actors".
Any two-cent wanna be pimp can take advantage of a female with a substance addiction.
With the explosion of the internet - a new form of rape emerged - called "Audition Rape". Quite simply - an 18 year old "child" is coerced into something they're not ready for.
Paul Ekman was a Professor of Psychology in the Department of Psychiatry at the University of California at San Francisco for 32 years and used 1/25 of second frame by frame analyis of video to determine if someone was lying.
Having done the same - for many of the original sex videos distributed on the early internet - it became obvious certain types of behaviour (eg. anal sex) was not "enjoyable" by the majority of participants AND that even the editing of some videos could not hide the fact the female participants were raped.
Not only (I suspect - have not fully read the new 2257 changes) should 2257 be toughened up by the authorities - they need to go after - and put in jail - assisted by Paul Ekman's science - those who took advantage of the many unsuspecting women.
2257 - YA - MEGA KEWL !!!
"No aroused genitals or reproductive fluids on any directly accessed domain name."
I have close to 1 GB of banners and no other images. The point is it is I*M*P*O*S*S*I*B*L*E to get 2257 for even a 1/100 of these. If the new regulation goes into effect (I guess it will) I'll just remove all banners from the servers. Less bandwidth too....woohoo
Will be interesting to see the effect on click throughs and sales. I may just end up earning more through this but I am not that sure lol
I'd rather not have to go through this experiment of text only sites

I doubt that with the highest 'D'. Even the Supereme Court wouldn't tackle with us artists. It would be the most foolhardy of attempts.
You have to understand, cartoonists, political cartoonists have been our most effective weapon against tyranny. We took down King George, Boss Tweed, Hitler, Nixon and we keep on rolling and with the net we're more powerful.
People don't always read, but they sure as hell understand a cartoon.
As this law is laid out, it would be stupid to attacfk a guy for a bannder ad.
As for the 'We must protect the women from the evil rapist content producer' that's bullshit.
What we need to do is protect each model from themselves and their stupid assed choices of friends and associates..
I helped change laws across the country regarding battered women and as I type am handling a murder case of a friend who may have been another victim of long term abuse.
The one thing that has never failed to amaze me is how women, in the U.S. granted the right to choose their friends and associates, so that they 'wouldn't' end up beaten, raped and taken advantage of, make bee lines to the same savage asswipes the laws were laid out to protect them from. Given half the chance women will still actively pursue a man without checking his background, without considering his character and associates and base their choices on his 'looks' and ' gee won't my friends think he's cool '.
This new law is cool that the government is showing it cares but it's only a band aid on a gaping wound: Hole In The Fucking Head.

I hate to ruin it for you all but after Kerry gets elected in November, the republicans will still run congress and be the opposition party.
The last "child protection (not)" anti-porn bill passed congress 99 to 1, with all the democrats voting for it too.
Even more in a Kerry administration, the democrats can't risk being seen as "soft on porn" so they will join the republicans in the battle - or risk a 1 term presidency.
Time to move to Russia. At least they don't ban porn and you can still get a politician hit for under 20 ruples.
Originally posted by DirtyWhiteBoy One thing I will never do, law or not, is violate the models privacy and pass her ID around. That's just not going to happen.

The 2257 is enforced by the DOJ. With Ashhahahahaha gone, they'll have more important things to do then arrest people on obscure bookkeeping laws.
The question of another COPA act rising though is a concern.
Within 24 hours of this law taking effect someone will sue and just like COPA there will be an injunction to stop it from becoming enforcable until it runs through the courts. So far COPA is on year 6.

If the 2257 turns out to be a worst case scenerio - we would have been much better off with COPA passing, not that the AG wouldn't have followed that up the a 2257 coup de gras.
Originally posted by xxxjay I doubt Jonny-boy really cares. He wants to clean up the internet, and he's gonna do it. He wants what he wants - no need to be reasonable.
Yeah, the conundrum is that the rule set forth are damn near impossible to follow. Do you have one set on content that doesn't have 2 IDS? Are you at the office all day for an inspection? Is all of your record cross-referenced, alphabetical, and in 11 point type?
My mind is made up on how I will handle my 2257 issues. I spoke, at length, and very expensively to one of the top 1st amendment guys that successfully defended Max Hardcore. You can too for $275 / hr.
Here is the long and short of it:
Q: Is the new 2257 scary?
A: Yes.
Q: Will it be enforced?
A: Yes, there will be enforcement prior to the elections. Whoever gets nabbed during that time will be prosecuted even if the administration changes hands. If Bush stays in power, prepare for 4 years of unmitigated hell. If he does not stay in power - this will all probably die back down.
Q: Is the Sundance case set a precedent to beat a 2257 rap?
A: Yes, it probably does, but you had better have around 125k of spare income to fight it if it ever winds up in federal court.
If you want to stay in this game: hire a good 1st amendment, prepare for the worst, get your ship in order, and have money to fight a case.
1- I am canadian and so are my models, I don't care if the american governement don't accept canadian driver's liscence as a proof of identity. Most of my models doesn't have their passport so fuck it. If my webhost is making me trouble, I'll switch to a canadian webhost. It would be sad cause I love webair.
2- I will never give my models private informations. ( Address, phone number. ) If they want it, they will have to write me a legal letter.
In short, I have their driver's licsence with their birth date, a signed model release and that's it. I won't phone my 400 models to ask them to show me their passport.

I don't not live in the UK but in Canada and my servers are US hosted. I don't know WTF i'll do.
I don't run paysites, only traffic generating sites.
For those of you who were at Internext for the 2257 seminar (which was very good - BTW) - would any of you have voted different after hearing the panel?
