    As some of you may be aware

    ...I inherited one of my ex mother-in-laws estate. I was the beneficiary on all of her accounts expect for one and the home was not in my name...so one account and the home has to go through probate (my Attorney said it will probably take about seven months). I learned from my Attorney that I will have to advertise in a local paper so that any debtors she may have had can have the opportunity to collect from me.

    It kind of seems to me that when a person dies one should be forgiven not paying the "garbage collector".

    That doesnt make any sense. People would just rack up huge debt's so there children can profit when they die.

    Visa would have to start charging us even more !!

        Yeah I always assumed once people passed away, their debts were written off. Hopefully none of them will see it in the paper...

            If you can inherit the estate you can also inherit the debts. Makes sense.

              Not really. His estate went to his wife and to a foundation...that he had established.

                      Yeah...and I suppose that I will have to pay the IRS their share although the money in the estate has probably been taxed twice before (once on her husband and once on her) so I will be the third one to pay income tax on the same monies. I don't know for sure about this...I will have to ask the attorney...as I think there is not supposed to be an inhieritance tax...for this sum of money.

                        Hmmm, interesting question to ask.

                        You'd probably have a different answer if you were the person owed money to.

                        One shouldn't be able to escape paying debts just by dying. This debases trust in our business system. So the law forces the decedent's estate to take care of outstanding debts (that can't be wiped out by death)

                            Yes I would ask this question to this forum .... NOT !!!

                            But with that being said we are not the ones to ask. Your attorney handling the estate would be the one to ask. Because there could be debts associated with the estate and some part of the estate could be collateral.

                            If the attorney doesn't find any debt's you will still have to post it in the public notices portion of your local paper.

                            Many times someone can have a debt but the deal isn't attached specifically to a deed or title and thats the reason for the notary in the paper.
