    Serious question regarding chargebacks and check fraud...

    Does anyone here know if there are any special requirements for a company or individual to attemp to collect from the people charging back and/or bouncing checks to paysites.

    This would be a 3rd party collecting on behalf of other websites the DO NOT own for a commission on amounts collected.

    I know, I know, this isn't a lawyers board but I was hoping someone would have some experience with this. If anyone knows that there is something required please let me know where I could find any info about it.

    This is a huge issue in the adult market and some partners and I are seriously considering giving it a go.

    Any imput would be appreciated.

        Yes, but I'm almost certain that you have to be licensed as a collection agency before buying debts to collect for yourself. I was hoping somebody would know exactly how this works so I could decide which way would be the easiest to get set up. I checked into mainstream collections (offline) but that was several years ago and I really don't remember the requirements.

            the thing is, since they are the merchant, they own the transactions. u dont really have the right to try to collect.

              Well, I'll definately look into it. Hopefully that isn't the case because that's 100% bs.

                    Plus they I do not believe you could actually file suit against them since they claim it was an unauthorized charged meaning they have little to no liability to payup.

                      Do you actually work in the adult biz? Of course it's not worth the effort for a small site that has like $60 hanging. I'm talking about on a large scale, I'll take a stack of 20's from thieving fucks anyday. Not to mention you can charge collection fees, bounced check fees, etc. Don't worry about the business model, I'm just asking if anyone knows about this at all.

                        wouldn't it be more cost effective to not accept checks at all? Wouldn't the costs balance out as opposed to being defrauded and trying to collect debts?

                              Someone who claims an unauthorized charge should by default get his credit card number blocked and a new card issued. That what normally happens when someon claims fraud but it rarely happens with any chargeback.

                                Actually this is not true. You can buy bad debts and then you own them and you can collect on them.

                                Stock if you're seriously considering this, then do a search on the Fair Debt Collection Practices Act. Their site will most likely tell you how you go about it. Also what you can and can't do, different states also have different laws regarding collecting debts. For instance in PA you can't contact someone twice in 7 days at home and you can not contact someone twice at their job in a 30 day time period...it probably has not changed but that was the law here in PA 5 years ago.
