Been there. Judge basically told the crown that there is no limit to self-defence and that you can't charge someone with assault for merely defending themself. He went on about the reasoning, but i could give you the case number if you ever need it to show to a judge,Originally posted by Elli

Your husband needs to get to a doctor, clinic or hospital and have both an HIV and hepatitis tests done within the next 24 hours...so i would recommend by noon tomorrow. I simply can NOT stress this enough. He must also make a police report. If it was a simple slap on the face no...but there was blood...his knuckles are scraped...he thinks he might have knocked teeth out...that means the other guy was probably bleeding and there could have been an exchange.
The first test is to prove he never had HIV or hepatitis prior to the attack. Future tests determine if he did contract anything.
You need to do this to protect both your husband and yourself. Sounds like the guy was probably on Crystal Meth. It makes people loony and it's widely available in the Vancouver downtown core. Very cheap drug but a real hard one to get off of, more addictive than heroin. Lots of crime in Vancouver due to that drug among others.
