the word is getting out and the stock is falling.
i've heard they have 60 new licensees from a mailing of 10,000 letters. i suspect that they might have 300 licensees by December 1.
acacia investors are beginning to UNDERSTAND that 97% of defendants will be FIGHTING these bogus patent claims.
defendants like Stanford University and Harvard Law School.
and something interesting about Judge Ware in California.
for those of you that think acacia has an easy slam-dunk with this judge think again.
"(Ware) also nixed Acacia's threatened motions for preliminary injunction," the message continued. "While Acacia has been threatening these motions for months as part of its effort to scare companies into paying up, it has not filed and has admitted that it does not have enough information to make such a motion. Reasoning that he would need to fully understand the case and the applicable defenses before he could even consider such extraordinary relief, (Ware) indicated that he would not even permit such a motion until after the conclusion of claim construction."
Ware also reportedly asked Acacia attorneys if "all the parties it planned to sue were before the court," the message said. "The attorneys responded that they were not and that they had placed additional companies on notice. When Acacia told (Ware) that they had sent out thousands of cease and desist letters, (Ware) seemed very surprised."
acacia's clumsy tactic of sending thousands of letters out to webmasters, many of whom do not even have video will backfire and be seen as what it is---an extortion attempt.
IMO acacia will NOT receive preliminary injunctions against ANY website business before April 2004 regardless of the merit of the acacia case.
which means IF you are sued RESPOND TO THE LAWSUIT.
see them in court.Comment

true,
but the turnabout (down) really started happening when acacia made the insane move of noticing colleges and universities---who are now BANDING TOGETHER and refusing to license.
in fact, the turndown started just about the time Stanford University got noticed.
Stanford University is in Palo Alto, California, in the world-famous silicon valley. More engineers from Stanford built and designed the internet and information technology than any other place.
word on the street is that Stanford and other large colleges and Universities WILL NOT BE SETTLING with acacia.
there's a reason Stanford will not settle with acacia.
there's a reason Harvard Law School will not settle with acacia.
when the best and the brightest do not settle with acacia it means something.
listen to Berman speak on the internet radio broadcast. he is not a techie, he is a lawyer salesman.
he couldn't even explain adequately what the acacia patents cover, lots of double talk about double dipping, etc.
these acacia guys are clumsy, and the geeks will eat them for lunch.
watch it happen.Comment

It's now in the discovery stage, I wonder if we will find out who signed and about their search for Prior Art?
I think I found a guy that signed and does not have the ballst to say so. 12clicks Just says he let his lawyers make the decision. Like if he did not he would be saying that.

I am, however, happy to read the posts here by Latinasojourn. Here's hoping this is the beginning of a long down-turn for Acacia, hopefully it is soon to be the last we'll see of their extortion tactics. But I hazard a guess that they aren't going to go away without a long fight, there is still much to do.

Fair enough. You need to realize though.... on that thread on 12click's board, some allegations have been made, most of which are a bit shall we say 'out of line'? 12clicks voiced his opinion that Brandon's fund isn't the way to go for those wanting to "fight the patent" right now. He doesn't believe that Brandon's intentions are 100% professional and above board, and since it is his own board I suppose he has a right to voice his opinions good or bad.Originally posted by Rivux

Paul Markham on the other hand, has reacted by basically accusing 12clicks of signing with Acacia.... something of which there is no basis in fact whatsoever I might add. It is certainly the right of anyone to ASK if a sponsor has signed with Acacia. However, no sponsor is compelled to answer that question, to you or anyone. If you don't get an answer, do you go off and assume the worst? Sorry, some people in ANY industry will tell you that what their company chooses to do or not do is, to put it bluntly.... none of your fucking business. Period.
Having said all that, I will point out right here and now that for myself, I must admit that my level of respect will be greatly reduced towards those sponsors and companies that do cave in and sign. I don't like it, but if we're being honest here..... I haveto say that that is true in my case, especially those sponsors and companies that have disclosed private information regarding their affiliates. When it all comes out, and in the end it will.... there will be some companies no doubt that find their loyal webmasters leaving their sorry excuse for a company in droves.Promote Wildmatch, ImLive, Sexier.com, and more!!

Paul started out by asking a question if he had signed or not since 12clicks has been hypocritical in his words and he wanted to see his actions.
Through their exchanges, 12clicks admits he doesn't support IMPA (i have the pages/text saved of that since i know he deletes posts) and finally answered Paul to say that he let his lawyers handle things... so with words, and not answering the question directly, is where the deducement came in.

12 clicks why all the personal attacks? I've seen it as well , you started attacking FTP quite some time ago.. Why? if you don't agree with his fight and you support Acacia then good for you but don't try to bash people that are trying to fight them, and help others.
Just because you may have caved in and signed up if you did, don't bash people that are trying to fight . You can allways question someone, but you have not , all you have done tried to Bash FPA every chance you get. This dose nothing but make yourself look like a tool..
Now go ahead and bash me for being a stupid newbie...In November, you can vote for America's next president or its first dictator.Comment
