    Has Acacia called you at home or at work?

    I am starting to get reports that Acacia is cold-calling people to verify information..as well as making verbal comments about the person's infringing on the patents by a telemarketing-style operator.

    Both reports were called at their home phone number, and they were being asked to verify their websites....so it sounds like they have someone digging through WHOIS database and trying to connect names with websites.....

    Sounds like to be preparation for what i have been saying will happen next, which is in December, expect to see more lawsuits filed...

    I believe the strategy is to do just like what they have already done...file a bunch of lawsuits and use an eminent court trial as a method for settling.

        That's still in question... already have webmasters in Netherlands and Denmark concerned about Acacia... trying to see if anyone in Europe can find out if EU policies of Patents will extend to individual members even if a patent is not specifically filed with that country.

            I get stuff from Acacia all the time, I am on about my 4 pack. They cant afford to take UK webmasters to court. It is minimum 25k sterling about $35k dollars per person so I am not bothered one bit.

                Good question... I am waiting for the individuals to contact me to see if they got a 'Final Notice' packet.. if they didn't, then that means they have hired some people to do some trolling through resource sites to find websites.... my guess is that these 2 individuals websites started with A...and are the first ones to have gottne hit with the calls with this new 'marketing' tactic.

                    we got the letter from acacia. Gave it to the lawyer. One check at the patent in holland. No problem. The letter went to the trashcan.

                                Yeah well I heard that a lot of people recieved packets without any urls or anything on them (like Amp and many others).. Wonder how Acacia's going to take those one? Too funny. I honestly can't believe the tactics they are stooping to.

                                          The EU patent (EP 0 933 892) was approved by EPO (European Patent Office) on October 15th, 2003.

                                          So Europe, duck for cover =)


                                          If a patent is technical, you can patent it in EU.

                                          The man I talked to at the patent office said that their patent was based on that it is a technical patent, not a software (which is not patentable) patent. That's why they got it approved.

                                          When I described to him what they want people to license compared to what they have patented, he said it didn't really match up. But of course, to get a professional opinion you need to get a patent lawyer.

                                          He also said that you have 9 months to object to the patent, if you feel that it's invalid.

                                              In case you were not aware, most answering machines have a record feature that allows you to record your phone conversation.

                                              Any interesting article about recording phone conversations and its use in court can be found at:

                                              From this article, it seems that it is legal to record a conversation (without telling someone...journalists do this sometimes), but it's not direct evidence in court, but could be admissable to corroborate testimony.

                                              The guy presents an interesting tip to help prove authenticity:

                                              "One of the big things you'll need to do is to be able to prove the authenticity of the tapes and to prove the time and dates of the recordings. What I did was after the call was finished and with the tape still rolling, I'd dial the local time and temp. number and get a time stamp or for really important calls, I'd call the National Observatory number in DC. The DTMF would be recorded and the charge would show up on the phone bill."

                                                        I talked to one webmaster who got a cold-call to his home number. His WHOIS info has his office number..and when i mentioned Matrix db, he connected back to a possible memory that in the very beginning of his business, he did visit Matrix and purchased Matrix content and might have used his home phone number then, before later getting an office number.

                                                        He did receive a Final Notice letter.

                                                        He said the person calling was like a telemarketer..they had no details of how/why he was infringing other than his name was on a list, and they were verifying the information. He asked how he was infringing and the caller said they could have a legal representative contact him.

                                                        They listed an old website that he believes further confirms it was matrix db, because they did not have his more recent and more active websites.

                                                          Interesting tactic..... on one hand, i know these telemarketers are just told what to read/do, and they are just trying to make a living... and giving them grief is mean.... but on the otherhand, maybe they should try making a living another way if they can't take the various kinds of responses people throw at them.

We had a strange call from the West coast the other day and it can't be dialed back in to. The guy made some pretty stupid comments to the hubby when he asked who was calling (they asked for me) and then hung up.

                                                                          Krome your talking about a company that has 40 million in assets and a lot of cash.

                                                                          $35,000 to sue a UK webmaster and WIN, then use that as a bargining method to scare the shit out of all other UK webmasters and other Australia and EU webmasters. Nobody knows what they will do they have the cash to do whatever they want, they wouldn't want to sue 300 UK webmasters of course but 1-2 wins and watch the other UK webmasters signing deals with Acacia in no time.

                                                                            If they don't have exact urls tells me this in their "Final Notice"
                                                                            You have to have previous correspondance to have a Final notice.
                                                                            Trying to extort money out of little TGP's /Mgp's is ridiculous.Alot of them don't make $1500 quarterly that Acacia wants for royalties.

                                                                              The UK webmasters need to to band together and petition whoever you do over there to try and overturn it. A good leader that can orate exactly what the patent would mean to future growth on the net... BEFORE they get around to you guys seriously.

                                                                              Your government might be able to look at this a little more objectively and see the damage it could - will do to future innovations. And the loss of tax on that good ol' VAT. ;-)
