    Legal questions for secretly recording sex

    Talking over with friends about the Paris Hilton tape brought up an interesting question. I know the Paris Hilton tape was consensual, but what about this scenario:

    You meet a girl at a bar, bring her back to your house. You two have consensual sex all night. She wants it, you want it, but you secrectly record the entire session. You have her on camera willingly having sex, as well as audio of her saying she wants it/enjoys it.

    The next day she goes to the police saying that you raped her. Now the entire night before was secretly video recorded without her consent and without her knowledge.

    My question is, can this tape hold up in court? Would it be used as evidence that she is lying? Even though she didnt have knowledge that it was being recorded, but there is 100% proof that she is lying about being raped. What would happen? Are there laws saying that...You will be found non-guilty of rape, but guilty of invasion of her privacy? anyone know anything about this?

    Many states have laws that say if its your house you can legally tape ANYTHING.

          I belive aslong as long as one of the people in question knows it's being taped it's legal... now dosn't mean you have the right to sell it... but it sould hold up in a court of law.. This is the same reason the police can wear a recorder or have someone do it for them.. with out needing a judge order.

            dude, it's illegal to tape a phone conversation with someone who doesn't know you're taping them. it *might* get you off the hook with the rape but you might end up with other charges on you.

            what's more, if you show she was fucked up enough, especially if you were the one getting her fucked up, legally she can't consent to anything, so be careful of this.

            if this really happened, best go see a lawyer!

                  Different states have different laws on this scenario. Many times having a tape of a conversation, while perhaps not admissible in court, is still a very powerful card in the hand one is holding.

                    If you have money or some good connections you are above the law. Anyone can get away with ANYTHING and I mean anything if they have good enough legal support. Look at Joe Francis, owner of girlsgonewild, they have indenifyed 35 underage girls doing sexual things like masturbating in his videos and I guarntee you he will walk away with no jail time and maybe a small fine or settelemet. Girlsgonewild made $96 million last year, $45 million of it went into his bank account. Hows a $3 million dollar lawsuit and $3,500 a day for attonery fees going to affect him? It wont at all, its a just a business write off and a lot of free publicity.

                      If you make a video, and she tried to take you to court.. Just inform her of the video that proves she would be lying in court and that would probably be the end of it..
