As for the problem going around about those that signed deals with Acacia giving up contact information; The original contracts from Acacia require the information be provided to them for anyone purchasing content that will infringe on their patents. If the company signed the contract they unfortunately are now required to provide that information. We required that section of the contracts be changed prior to signing. We at www.DomainGirls.com will NEVER provide any information of our clients to Acacia and it is in our contract with them that we don't have to. I do feel bad for those that did not think to require this change and I also can not fully be angry at these companies for then providing the information as they no longer have a choice since they have now entered into a legal binding contract. They are pretty much F***ED and therefore so are their clients. Hey Matrix is big competition for us so while seeing all this bad press about them should make me feel glad I still can't help thinking it's not all their fault. They are stuck if they signed the original contracts. And I really feel bad for their clients that now are royally reamed since Acacia will now have them in their sights. But on the good side for everyone is all the trouble Acacia is finally facing may help eliminate the threat soon...

Is there going to be an official type boycott of them. They are for sure 100% the people who gave my info out and it just pissed me off listening to that bullshit interview.

Please do us all a favor and don't try to spin your decision to settle as doing a favor to your clients.

The fact is that now Acacia does not need a list of your customers to go after your customers as potential infringers. Your signing the license means that anyone using your content could be a contributory infringer and gives Acacia clout to go after them.

Care to post a copy of your license if you think it is so righteous and protective of your clients?

BTW, I remember Matrix putting in 5 figure dollars into this fight originally before anyone knew there was a problem. What have you guys done lately except agree to a nebulous, overbroad patent?

I didn't say it protected our clients. I said we will not give Acacia our clients info. Acacia will go after everyone regardless but they won't get the info from us. Acacia has only filed a handful of actual suits:

several of our providers who couldn't afford to fight had made a deal by removing the video content for sale from their own sites and Acacia dropped suits. Effectively eliminating that side of their business entirely. By us paying the license we can handle their content for them and they are not responsible to Acacia for it. Yes it does say this in our contract. As for webmasters that buy video content from us we are required to inform them of the Acacia patents and that it is their responsibility to take care of it, but we do not provide their information to Acacia and our contracts state that as well.

For us it was all about the money... No if's and's or but's... Plain and simply we could not afford to fight and if we had we would be in court right now, not like those lucky (if you can say that) bastards just now getting their letters.. it will take months and months for it to progress to a point where their ass is on the line and with any luck by then Acacia will be bye bye.. Hey I flat out say they will lose (I hope) but unfortunately patent infringement law basically states guilty until you can prove innocence. So in other words LOTS of money to fight. Whether they are in the right or not is meaningless. And you already know this.

Remember we are in a little different boat then the regular adult webmaster. We are Brokers/Providers only. We do not run any pay sites offering video content so our side of the problem is a little different. We have fully supported the fight in every way we could that didn't cost money. We were actually one of the first people to bring this problem to AVN's attention a year ago and request public coverage. We were even supposed to participate in an interview about it but it fell through for some reason. As the paperwork and court docs escalated to where we could no longer avoid going to court we settled. We don't have the money of Matrix and HomeGrown and I wasn't going to fold my baby to try and fight.

So yes we did protect ourselves (as anyone would) but unlike others we also thought of our clients and buyers and respected what they needed at the same time as best we could. And this is why we got our contracts changed before signing.

I have yet to hear from them about their recent addons.

You don't have to give Acacia any client info. You gave them a license and an affirmation. As I said before, they will use that against anyone and everyone that they think money can be squeezed from.

Everyone understands "we made a business decision" and that is fine. I just have issues with you jumping in to try and suck away some biz from Matrix while they are so vulnerable.

From my position as a defendant, you and Matrix just look to me like a couple of settlers... nothing wrong with that... you do what you have to do.
