          ok gents and gals,

if you have read some of my many posts about acacia you already know i am not one of the guys saying "fuck em they have no case i don't have to pay". Instead i actually care and look into the reality of it all. bottom line is this. Just because you got a letter doesn't mean anything yet. out of the thousands of people that have gotten letters only a handful have actually been filed against and had to deal with it. And as you may or may not have noticed those that actually have to deal with it are NOT the ones saying it is BS. We know it is BS but we also are having to actually deal with it in court. Just FYI for those of you saying "demand a jury trail and they will lose". I think you are VERY wrong and so does Acacia. In fact Acacia is the one demanding the jury trial. Why do you think they are going after the adult industry in the first place? Because they know they can find a jury that will hate us before the case even starts. If you are going to talk shit about Acacia, those that settled, and those that don't fight, then at least learn a little of the real information around it, patent law, and costs. And for all of you that want some REAL court info have a look at this and see those that have actually been filed against and that have dealt with the courts and those that are dealing with it now(first few are not the right acacia)
          http://corporate.findlaw.com/scripts...a&SC=Search%21

Also know this; not everyone that settles has settled in the same way. Some caved completely and signed their contracts as they were, others of us fought and had the contracts changed to better suit/protect us and our clients and their information. You will also notice in the link above that several of the companies with the money are fighting, counter suit, etc, etc... they are the ones that are helping out the rest of us get rid of Acacia. they are also the ones that can afford to do so. So if you want send them an e-mail thanking them. i did.. beats the hell out of threating to to dump them if they don't fight.

Excellent post.... I thought you had to pay for this kind of access.... now I see that the public can peak into the world of the patent process.

I think what you are seeing when you click the Continuity Data is that their patent is open and they are amending it... adding on new additions to work around prior art as well as to try and give more depth and direction to the patent.

This is normal behavior for any patent holder, to keep their file open and adding more stuff to the patent.

Why would they be allowed to add more things to an old patent?

Once they have filed it, they should not be allowed to add more to it.

Can you file a patent for a light bulb and then amend it to cover house paint?

It seems like once you file you should be locked in to whatever you originally filed a patent on.

If you do amend it, you should not be able to sue anyone for any infringement prior of the latest amendment date. How can you change your patent and then sue people for using it before you changed it to what it is now? That makes no sense and should be illegal.

I support reasonable IP rights, but the current system needs to be fixed.

                  thanks for the link
did anyone read one of the pending patent abstracts:

                  United States Patent Application 20030031248
A system of distributing video and/or audio information employs digital signal processing to achieve high rates of data compression. The compressed and encoded audio and/or video information is sent over standard telephone, cable or satellite broadcast channels to a receiver specified by a subscriber of the service, preferably in less than real time, for later playback and optional recording on standard audio and/or video tape.

When Acacia was on the D-Money show, they said they had 500+ claims they were trying to add to the patent.

So all these claims they are looking to add isn't surprising.

Like many inventors, he probably got screwed on the deal and made out with pocket change when Acacia acquired the patent from him.

It's probably very analagous to a record label signing a band.

But if they add the claims today, how can they turn around and sue people for infringing on those claims yesterday or for the last few years? If even they didn't claim their patent covered certain things until today, how can they sue someone for using whatever they now claim, previous to the date they made the claim?

Does that make any sense to anyone?

Ya, i heard that they were trying to add dreams to their patent.. since what we see during the day is downloaded to our brain and is replayed in our heads...

This is how it fits into the patent:

Our eyes digitize the visual and audio content, compresses it to fit in our brain, and stores it into short term memory.

When sleeping, the Dreamus OFactus downloads archived files through the NeuralNet, and replays them on the Visual Coretex HDTV monitor.

Now the remote distribution component of the patent is where it may get a little tricky, but people seem to sometime have the same dreams, so that gives some quasi-scientific evidence that people in remote locations could be downloading dream files from a person... thus completing all aspects of their original patent and amending it to include everything possible.

No idea. Makes no sense to me either.

I can see in certain cases leaving a patent open and letting people make some additions just to tighten the patent up or clarify things that couldn't be forseen, but an open ended patent where you can make dozens or even hundreds upon hundreds of additional claims over the course of 10 years and make the patent even broader seems stupid to me, too. So I'm with ya.

But this is the office that gave a patent to a 7 year old for swinging on a swing, so nothing surprises me anymore with them.

The Patent Office is backlogged with new patents, not to mention current patent holders amending their patents... all piles up... but these new amendments won't be of use if the core patent is found to be invalid.

An interesting point about being able to jump into the pending applications with some prior art..... it would take mounting up an attack on the patent by having some patent lawyers go down there with prior art... something that I would LOVE to do if Fight The Patent Foundation was in operations.. so for now, I'll just continue to study up on Patent Law and prepare for the Patent Exam and eventually take the test....if i pass, it would allow me to petition the USPTO directly on patent cases.

Allowing clarifications to be added would be fine... but face it, when you patent an IDEA, you should NOT be allowed to add to it when 8 yrs down the road someone else comes up with something that you could VAGUELY infer used YOUR idea and make them or others pay you. I mean you had a SPECIFIC idea. Allowing someone to file to include new technologies is just plain ludicrous.

Now IF the patent holder INVENTED the new technology, it would be a different story. But to allow them to include someone ELSES invention...

What you see there are the "buds" of Acacia's "patent tree". As it exists now, you have:
                                      U.S. Pat. No. 6,144,702, filed July 23, 1998
                                      This is a division of
                                      U.S. Pat. No. 6,002,720, filed Apr. 10, 1996
                                      which is a continuation of
                                      U.S. Pat. No. 5,550,863, filed Oct. 8, 1993
                                      which is a continuation of
                                      U.S. Pat. No. 5,253,275, filed Apr. 2, 1992
                                      which is a continuation of
                                      U.S. Pat. No. 5,132,992, filed Jan. 7, 1991

A "continuation" of a patent is a direct outgrowth from it's parent patent, while a "division" is a fork or branching of the parent. Another way of looking at it is that a continuation is the same invention evolving to keep pace with technology advances while a division broadens the coverage by actually describing two different inventions.

To get an idea of what's happening here, go to http://pair.uspto.gov/cgi-bin/final/home.pl and enter 5,132,992 into the "Patent Number Search" field. Scroll to the bottom of the page and you'll see the "File Contents History" for the patent, usually refered to as the File Wrapper. Starting at the bottom, you can see all the items, in order, that comprise every bit of corespondence, the prosecution history, records of decisions and whatever else the PTO feels fit to include. You can order a copy of all these documents for $200, btw.

So, now click on the "Continuity Data" link and look at the listing. These show the applications that have a dependency or child relationship to Patent # 5,132,992. Each one of these will either:
1.) Become a continuation of 5,132,992, advancing the invention.
2.) Become a division of 5,132,992, describing a similar, though different, invention.
3.) Or be rejected by the PTO.

Most of these applications in this list are linked (on the left hand side) to their File Wrapper listings and, by following those links, you can see the course they are taking through the PTO. In fact, these are (possibly) the embryos of File Wrappers of future patents, some of which may differ enough from the parent that a whole new license may be required when it's shown you infringe on that one as well!

One thing to note in going through that listing, many of them (such as Item 10 of http://pair.uspto.gov/cgi-bin/final/...ion&USERCODE=0) have a "Petition Decision of Granted to Make Special". What this means is that the application is being expidited, speeded through, and there are only two reasons that could apply for the special handling, by having done and submitting a Prior-Art Search and/or Because of Actual Infringement (see http://www.lawnotes.com/patent/accel.html for all the reasons).

Bottom line is, this is a monster that either needs to be chopped down as the weed it is.
