    How do you incorporate? and is it expensive to do it?

    I was just told that I really should incorporate, but I dont know shit about incorporating.

    Talk to your accountant or tax attorney. If you make a decent amount of money it's worth it.

        I had someone take care of it for me. Think it ran me something like $500, still not done with lawyer crap though. More fees coming down the pipe!

          You can file for incorporation yourself, but it isn't worth it. Spend the $500 or so for a lawyer with corporate experience, because he'll be able to determine exactly what type of incorporation is right for you, ie, which will give you the best tax breaks and the most limited liability.

            Take to a professional, and file it in nevada or Arizona, they don't charge franchise tax (or state tax?).

                              I incorporated a biz name a few years ago cost only $50 a year. Thats for the state of CO, for each state their are different laws. I just did it because I am self employed and it saved me money on insurance. Was really worth it... saved me about $20 a month on insurance. Also ment more junk mail in my reg mailbox though.

                              Just had to go down to the city and county building.

                                Make sure you hire an attorney that knows what they are doing

                                the income you bring in etc will determine if you should have an LLC, An S corp, a C corp etc.....

                                    It cost us 300$ with an attorney, and we had the tax ID the in 3 days.

                                      You don't need a lawyer!! Information on HOW to incorporate is available all over the internet. Anybody can incorporate and it does not depend on income. "Incorporation" only takes the form of a C corporation or a S corporation. C corporation you're subject to double taxation which you obviously want to avoid unless you're going public or something. S corporation, on the other hand, is taxed the same as a partnership (no double taxation) but enjoys the same limited liability protection as the C corporation. There are a couple of restrictions when it comes to a S corporation including 75 shareholder limit and more. Information on restrictions are all over the internet!

                                        You don't need a lawyer That's got to be one of the biggest myths out there.

                                        The process is incredibly simple, and your taxes are not that complex to do. All the documents on the irs web site is sufficient for you to figure out this information yourself. If you want to be an S-Corp, read form 2553, if you have employees and need to do payroll, read circular E. You also need form ss4 to get a federal tax-id number. There's a wealth of information on the IRS website; don't be lazy. Corporates are created at the state level. Please see your Secretary of State's office to get the appropriate forms.

                                        I have no idea what they do in other countries, but I'm sure the information is readily available in whatever government office you need to go to.

                                        Also, people hiring "resident agent" services for 99$ or so a year don't even need to do that. As long as you have an address to which a process can be served (not a PO box), you can use that person/address to be the resident agent (of course they will know about it and agree to it).

                                        People get very scared inside when they hear the word corporation, because they automatically think of huge companies like IBM, etc... and think that the process is very convoluted and requires thousands of dollars in lawyer fees to get accomplished.

                                          The best place to start is your state?s Secretary of State office. A lot of them have very nice websites with all kinds of free relevant information. If you want to do it right first go to your Accountant and ask him or her what type of entity will create the best tax consequences and then go to your attorney and ask him or her what type of entity will provide you the most legal protection. Now if you just want it down and dirty go to the appropriate Secretary of State Office, and read up on what is required to form an LLC and do the paperwork yourself

                                                      Yea, my lawyer is an old family friend and when i went to create my s-corp everybody said "you need to talk to a lawyer". so i called him up and he said "you know, you dont need a lawyer. in fact all i am going to do is give you the paperwork to fill out and then i am going to mail it. and if you were to ask me to do it all i would do is get the information off of the internet and it would cost you my hourly rate. and to tell you the truth i'd rather not do that"

                                                        If so: Nevada or Delaware.

                                                        Once you know, you can incorporate by yourself on line at the above links or at my signature. ( Delaware corp for 450.00 if I remember right).

                                                        But check with the lawyer.

                                                          We let these guys handle everything from yearly stuff to filing for us and they done a great job for an LLC for less then $500.00, I recommend them for anyway who wants it done properly and fully, sure anyone can file inc papers at their local courthouse, but thats not enough.
