It's a long story...but it has to do with a video I filmed a while back...gave me a fake id and I removed it from the site, it was already up for a review in a magazine and I couldn't get it removed from the magazine as it had already printed...now they guy is saying he's going to go to the DA, get a lawyet etc...and take me to court for printing the box cover.Originally posted by Trax

Also you might consider burning them to cd and mailing a printed copy or two to yourself and then keeping them unopened. Then you have the United States Post Office's word that these existed as of the date on the postmark. Could prove useful.Comment

As for lawyers, I know none in Southern Cal, but those mentioned so far seem decent. However, Larry Walters (www.firstamendment.com) is affiliated with a law firm with offices in San Diego.
As for the Fake I.D. - Bury that issue deep. Tell your lawyer, but you never want that shit to surface because you never know how the fuck it will be interpreted. It could easily be turned around and in your face.
If this shithead is really a "batallion chief" in a firestation, then he must be a real dumbass. You, with your lawyer, could easily turn this around on him. A couple of things. You could go to the DA with extortion charges. How the fuck do you think the "batallion chief" would look in the local media trying to extort sex (essentially trying to coerce someone to be raped)? You could also simultaneously sue his dumb ass for intentional infliction of emotional distress. You could also talk to your lawyer to see if you can press "stalking" charges against him. Cyberstalking is statutorily prohibited in California, I think. Your lawyer should have a quick answer on that one.
Also, Good job saving the Instant Messages. AOL will have a record, maybe. Your computer hard drive will almost for sure have a record, unless you wipe the slack space and unallocated areas of your drive. However, if you really look at porn online a lot you probably want to avoid anyone doing a forensic examination of your hard drive. However, the police, with the evidence you provide them of the extortion and stalking, could likely seize the perpetrators computer, and then search it for corroborating evidence. He would likely be fucked if they did.

Fake IDs are illegal if used, but if an underaged girl get's into a nightclub and starts drinking, who get's in trouble? The nightclub owners: They have a responsibility to hire personel that can reasonably determine the validity of the ID and the person's age of majority. At least that's how it is in SC; it could be different in CA. I hope you have a copy of the ID. I would imagine an arguement can be made in your favor if the ID was a really good fake, but against you if it was obviously a self-laminated printout.
I would also try and contact AOL now and get confirmation on the IM transcript, just incase they dump their records after X number of days.Comment

The ID was read but it was of someone else who looked just like him, and signed his name on the release. The id itself is not fake...just that it wasn't actually him. Clyde Dewitt is an associate of Larry Walters and I'm waiting for a call back from him and a few others. AOL has transcripts of everything if court ordered so I'm good there, i haven't erased anything off my computer so it's there as well as in the log i made of it. I can't contact him by phone as the phone # i had is not valid. It's a mess, but the lawyer I retain is going to bury this guy...I think his only motivation is to fuck with me. Once he finds out he has no case against me with the DA he should drop it, cause if he really is a battalion chief he's screwed. They have a code of conduct to follow just like police. I'm waiting on the attorney now so I'll let you know what happens. Thanks for all the help and advice.

I'm not a lawyer, so if you know different, correct me if I'm wrong, but it doesn't sound like it'll get too bad. Providing you destroyed all evidence of the original video (and I mean wiped...non-recoverable), then all you have that could be contrued as CP is the copy you gave to the chief.
On the criminal side, that could constitute possession and distribution of CP. Would they pursue it? I doubt it. One small picture that is questionably of an underaged guy, but you have a valid ID of a legal guy, who might actually BE the guy in the photo for all that can be proven? They might could make a case, but have bigger fish to fry.
The civil side might be worse: I don't know the language, but the chief might could sue for somehow associating his publication and himself with CP, but I would assume he also has the same responsibility to validate the photos he publishes...otherwise he could be under the same possession/distribution charge, if not worse since he's directly distributing to a larger audience. Plus, if you counter-sue with the above implication along with the extortion charge, I bet he'll backpedal real fast.
The other civil possibility is from the guy who's ID you accepted. Make sure you don't use his name anywhere, otherwise THAT could be a huge lawsuit for defamation of character. You definitely don't want to touch that one.
Final word: If you talk to the DA, have your lawyer present and remember the 5th amendment. Don't admit shit. The only proof they have is the copy, but if you talk about how you filmed this minor in sexually explicit scenes, you could be slitting your own throat.
