Acacia Patents & USPTO... a question

    Acacia Patents & USPTO... a question

    Is it normal for the uspto.gov site to show all patents in an Examiner's hands when doing a PAIR search on any patent? A search on their site shows all 5 of Acacia Technologies patents in the hands of 2 Examiners since 10/15/03. Are these normal processes in the legal system whenever there is litigation or could possibly the USPTO be wondering if these patents are legal? I'm just fishing for information.

    Don't try and figure out the USPTO. That place is totally discumbobulated when it comes to review of technology patents. Our attorney fees to handle one of our patents would make most folks here choke on their dinner.

      Take it as you wish. I found it interesting that as of 10/15/03 all were in Examiner's hands. Who's to say that Acacia didn't know it and sent us those crap letters to try to make every buck they could until those patents were overturned? It was just a week or so later that the latest letter binge started. It probably took that long to put it all together. I could be wrong, but someone tell me that what I am seeing on the USPTO is *business as usual*.

          It could be that they are amending their patents.. this does happen.. kind of a way to tie up loose ends when you have a broad patent such as theirs. Do post what you find out... I'm very curious to see what they've been up to.

                  Very interesting. They could very well be under the review process right now.

                  Reexamination Proceedings:

                  Under section 301 of the U.S. patent statute, any person can file a request that the Patent and Trademark Office reexamine a patent on the basis of prior-art patents or printed publications. If the PTO determines that a substantial new question of patentability exists as to some or all of the claims, it will conduct a new examination of those claims.
