    Obscenity Laws

    The Republicans send the anti-terrorist people after the pornographers. I guess a lot of conservatives wondered why Bush hadn't taken any action regarding porn for so long. With elections coming up, Bush is probably trying to rally the ultra right wing of the party:

    The Resolution (H. Con Res. 298), sponsored by Rep. John Sullivan (R-OK) and other Members, notes that the Supreme Court has not only upheld the right of legislatures to pass obscenity laws but has recognized that there are legitimate governmental interests at stake in stemming the tide of obscene materials. Such interests include "protecting the quality of life and total community environment; maintaining a decent society, protecting the social interest in order and morality, and protecting family life."

    "The Resolution will serve to support Attorney General John Ashhahahahaha who is being urged to begin a vigorous obscenity prosecution effort, and it will send a message that the Congress sides with families, not with pornographers."

          if they defined what was obscene, we would have no problem working with them, and they wouldn't get to tell the midwest that all porn sites were obscene.

            my concern is in most states even taking softcore nude photos is obscenity... hence anything can be prosecuted.

                They won't define what is obscene because that is there free ticket. It gives them the freedom to deem anything obscene they feel fit to taylor a specific case.

                Its a huge loop hole for prosecuters and is total bullshit in my opinion.

                    The bottom line is this:

                    What is obscene in America is not what Ashhahahahaha, or a group of republican senators think is obscene.

                    What is obscene in the USA will be determined by a JURY of ordinary people.

                    A jury that is a composite of the community, people that have registered to vote, and many with some education.

                    A jury with college kids on it who grew up with MTV. A jury of old-timers who have cable tv and watch porn at home, a jury that has been bombarded with unsolicited email (which does annoy them, but is no longer shocked by "porn".)

                    IMHO, standard fare explicit sex will be very difficult to convict for obscenity in the United States simply because it is everywhere, even on the socalled "soft" playboy TV channel.

                    BUT, IF you merchandise what could be considered "degrading" or violent sex, excrement sex, forced sex, underage sex you will probably have some problems.

                    And that will be because a JURY will be offended by it.

                      Is there really any meat to it or is just a declaration of support? If it is just a declaration of support without any really teeth is doesn?t mean shit. It is not going to change the minds of the justices on the court that are already inclined to rule one way or another on the applicability of community standards test in obscenity cases involving Internet porn. Maybe it will be a wake up call to all of the Republican pornographers that profess their homosexual man love for George Bush and other conservatives on this forum.

                                latinasojourn, you're still talking court, which means charges pressed. what we do is currently legal, but our government wants to pretend it isn't - the general run of adult sites shouldn't BE prosecuted - it's fucking LEGAL!

                                        It is my understanding that the Supreme Court has defined what is obscene in the sense that they left the definition up to community standards...which I admit is far from any specificity. If a prosecutor chooses to prosecute...you are left to the definition of obscenity by 12 people in the community...6 people in some jurisdictions.
