I would advise not playing the language card until the legal notices start flying. Of course since Acacia is undoubtably reading this board you've already tipped your hand.

That's an idea, call them after hours and leave a message for them to call you back at an 809 area code number.

I wrote to you at about 5:15 telling you that I'd be online after the trick-or-treating with the kids - haven't received your response.

macromind, as it says on this thread, almost anyone in canada with a paysite has a u.s. business presence. a u.s. business presence means a u.s. patent can be enforced if valid.

Because of the fucking around VISA has been doing, most of the operators of paysites have a US presence. If you are not running paysites, and your company is based in Canada, I think Acacia might be barking up the wrong tree.

Remember: There is a big difference between a legal notice and someone just mass mailing a "give us your money you bad person" letters.

The correct answer to those letters is a simple reply that says "I am based in Canada. I don't own or operate a US company. I don't feel that I am in violation of any patent that applied in Canada. At this point, I decline your offer, as I cannot see how it applied to me. If you can provide me more detailed explaination (siting examples, URLs, and applicable patents), I would be more than happy to review that information when provided. Until I am able to clearly find where I might be in violation, I cannot agree to pay any fees or enter into any license agreement with your company."

Make them go chase their tails.

BTW: VERY VERY VERY IMPORTANT: Their lawyers, unless licensed to do so, cannot directly act on you in Canada. They need to get laywers allowed to practice law in each of those areas. Any letters coming from outside are, IMHO, nothing more than "please give us money" letters, with NO LEGAL STANDING.

Don't ignore them. Reply in the negative, ask them to site examples and details, and make them explain why a US based patent out apply in Canada.

If they answer, THEN you get a lawyer.
