Two things

1) Yes, hotlink the MF background!
2) Create a rule in Outlook that will send the guy a reverse email like this:

>Subject: please remove your background asap on XXXXXXXXXXXXXX

>Your background is stolen
from my site

>plesae remove it now, or i will take legal action against you
