    EU acacia patent

    hello, and fuck you all..

    i live in EU and got the famous final notice from acacia.. i don't get it !

    article 52 of the Convention on patents states that software is not patentable
    two different computer systems or networks so as to allow communication and exchange of data content between them, such use should not be considered to be a patent infringement.

    when i look at http://www.acaciatechnologies.com/patents.htm
    i can see that all the eu patents are just translations of European Patent No. EP 0 566 662 from the european patent office. so all we have to do is to file a complaint that this patent is no longer valid, and all the european patents will disappear.. or what ? that might also help our US friends (and those of us that do business there) in fighting acacia..

    we need is a GFY member located in Munich to go and file it

                Thats all fine and good if your sites are hosted within europe, but what if they're hosted in the U.S.? All it takes is an injunction and POOF.

                  if they try to damage my business anywhere, i will file for damages locally and seek to get security (not sure how to formulate that in english) for my losses against their local holdings (read: their local patent)

                        In Document EP0001339236A2 the Applicant is Acacia.

                                        It's tough to get involved from the US side, because it means lobbying Congress to tell the USPTO to stop putting pressure on EU Patent Office... this is a long term battle, much like Patent Reform...that requires ALOT of money for lobbying, an alot of insider connections... this is where this effort is well beyond me.

                                        I am looking to attack the problems from both the short term prespectives of helping defendants to defend against a patent abuse case as well as long term by petitioning to invalidate patents directly with the USPTO.

                                        Efforts like this, when combined with existing organizations that are lobbying for US Patent Reform and groups lobbying for EU patent reform (ie.no software patents), is where people are making a difference at different levels, we only differ in how we choose to fight.

                                              I might be wrong, but it is my understanding that the changes outlawing software patents and business process patents in the EU have not become law yet and there's some doubt as to whether they'll ever become law (ie powerful lobby groups including the US Govt are working against it). Accacia's patents will presumably remain valid in the EU until such time as the legislation actually becomes law.

                                                      you are right, we are not home safe yet.. Article 4a: Exclusions from patentability http://swpat.ffii.org/vreji/papri/eu....en.html#art4a are still under attack by companies like acacia. the issue still must be debated by European Union (EU) member states before a new law is passed, however. this is going on right now, and as far as i am informed the contries are discussing their position AS WE SPEAK, and will have the final vote of support or reject on 10th of November. http://www.infoworld.com/article/03/...upatent_1.html
                                                      This means that local politicians are having their debates/votes now, and we need to do the following:

                                                      Contact all your local news media, politicians, political activists TODAY and provoke them to bring issue in tonights news. Ask them this simpel question:

                                                      If entertainment companies are forced to pay Acacia Research (a US based company) 2% of their income, then how much must you pay to stream video containing: ?

                                                      1. critizism of George Bush ? (famous idiot)
                                                      2. critizism of bin Laden ? (famous caveman)
                                                      3. critizism of Hu Jintao ? (communist party general secretary china)
                                                      4. critizism of the european patent office ?
                                                      5. critizism of Acacia Research ?

                                                      That should really piss european politicians off. This must be done TODAY, our enemies are lobbying hard right now.. get the message out everywhere you can..

                                                          Since the European Parliament voted for clear exclusion of software from patentability in september 2003, the patent movement has been fighting back through the EU Council. A EU directive can only become law if Council and Parliament agree. The position of the Council will be prepared by a workgroup of national patent officials on thursday 2003-10-23 in Brussels. At the meeting, the European Commission's patent officials may propose to disregard the European Parliament's amendments and go back to earlier texts from the Commission's and the Council's patent officials which allow unlimited patentability. The UK government, whose patent policy is determined by its Patent Office, is expected to push for this option.

                                                            The European Parliament voted on September 24th for a directive proposal which confirms the existing European law, makes software explicitely unpatentable and codifies additional safeguards, such as freedom of publication and interoperation. The amended directive proposal thereby achieves the claimed aims of the European Commission, especially "harmonisation and clarification of the status quo" and "prevention of a drift toward US-style patentability of pure software and business methods". However, the European Commission doesn't seem to be happy. Internal Market Commissioner Frits Bolkestein and others have been threatening to withdraw the directive project and to pass the ball back to national patent administrators and, should that fail, to rely on brotherly help from Washington. But the European Parliament was neither deceived nor intimidated. Now the patent movement's strategy is to dismiss the Parliament's position as "unworkable" and to attribute it to "ignorance" rather than to a conscious policy decision. Bolkestein's friends can be counted on to resort to whatever inconsistency, illoyalty or illegality is necessary in order to obtain what they really want: "legal security" for the owners of more than 30,0000 US-style patents on software and business methods, granted in accordance with a law-to-be, which the European Parliament has refused to pass for them. A few months of intense struggle lie ahead.
