1) Acacia's "final notice" letters will not get you in the door of the courthouse to get a DJ hearing. It does not show any threat of a lawsuit, so this is not an option. If someone did get a letter that said someting to the affect of "if you don't pay us the license, we will sue you".. that's a WHOLE different story, and you could consult your attorney, and that would go under the Fight it category.. which can now be broken down as a) Join the Defense Group b) Defend them by yourselves. from the letters that I have read, they have crafted their letters to avoid a possible DJ angle.


2) Petitioning the USPTO is a bad idea unless you have the prior art and the attorneys to back up the petition request. Yes, anyone can file that $1,000 application.. but if every webmaster did this, and didn't have SOLID prior art, and expensive Patent Attorneys handling the case, I believe MORE HARM can be done by these good intentions in causing the USPTO to be become desensitized to additional petition requests. Read the posts at http:/www.YouMayBeNext.com it's not so easy to your petition for patent review approved.... So to me, that's not an option for the average webmaster to do.

And yes, maybe i should have listed all of the possible angles, and give my opinions for each... i just narrowed it down to more realistic options based upon the number of webmasters that I have been chatting with.

3) You can't give legal advice, unless you are an attorney. I can present the options at the point of writing, and update them with further ones (just as you have suggested). I have clearly stated that I am not an attorney.

It's not breaching unfair business practices to present information and opinions, so long as 1) I never give any indication that I am a lawyer and 2) present false information.

I am sure there will be points 3) , 4), 5) , etc..to why i am not breaching any issues, but that's a starting point.

Acacia filed charges against IMPA for antitrust issues and IMPA is dealing with it.. different situations..they comprise of a group of people, namely the defendants, and are an association. I am an individual.

I understand the intentions of your post, and appreciate your concerns, but I don;t feel i have stepped over any boundary lines except for making long posts.

Should Fight The Patent Foundation become an actual entity, you will see my postings be heavily filtered by FTPF attorneys.

Does anyone have access to the archived interview with Berman a couple months ago? Can't even remember the show he was on..

I'd love to hear the clip of him saying that they were NOT be going after webmaster affiliates and the only one they would require to be license would be the initial source.

All the webmasters who are concerned should be aware of impai and donote to the cause.

We are definately not paying the bastards one cent, acacia can fuck off and die!!!!

Support the sponsors that are fighting and dump the pussies that settled. Sponsors that settled are putting money in the pockets of Acacia's lawyers.
