more respect for sponsors that admit to signing with acac*a than the WON'T say ones

I've been following these threads as so many of you have and I'm finding one thing to be more and more distasteful to me ... the closed mouth, disappearing act sponsors that won't step forward and tell whether they've signed acac*a's license or not.

As has been said 1000 times, this is business!
If a sponsor felt it was in his companies best interest to sign, then so be it, but at least have the balls to TELL US! If you've done as another sponsor did and had it put in the agreement that their affiliates pushing their sites are protected under your sponsors license ... TELL US.

I know you are leary of a revolt from your affiliates but consider this:

    Its OUR business too!
Your affiliates are now recieving letters trying to scare them into licensing, you know this
You also know whether some of them could rest a bit easier knowing if they link to only you, they are ok.
You should have enough respect for those that in the end help to increase your profits by sharing those two tiny bits of info.

Personally I have exceptionally more respect for a sponsor that comes forward and divulges the information I need to make intelligent decision for MY business, than one who hides under a rock and hopes nobody will notice

Those of you choosing not to tell whether you signed or not are higher on my list of 'i'll pull their links in a heartbeat' than any sponsor that stands tall and tells me the truth!

You do whats best for your company but damnit allow me to do whats best for mine too - and anty up!

For those of you saying its none of my business what adult.com or maxcash (using them as examples) do about acac*a
you are kidding nobody but yourselves.
IMHO Only a fool would be willing to make decisions when only 1/2 the information is presented to them.

thats only the second post since 1997 where I have spoken my mind in relation to what I consider untasteful sponsor actions ...

if you have a problem with it - too bad, it'll hopefully be another 6 years before you see it again

I don't think I have heard anything from(or about) ARS in this Acacia thing. Where do they sit in this episode of "Roaches vs The World"?

          Very well said!

I'm glad to see a focus on those who HAVE REMAINED SILENT THROUGH ALL OF THIS!

Funny how these guys spam EVERYWHERE when there's a new program.... or giveaway.. but now are TOTALLY SILENT .

Vicki I can tell you that the deafening silence on this issue is an indication of a lack of loyalty and respect on the part of the sponsors in regards to their webmasters.

These sponsors have NO RESPECT for ANY OF YOU!

I think it's time that EVERY WEBMASTER on this board request an answer from EVERY SPONSOR via email to where they stand on giving your personal info away.

I have sent email and received NO RESPONSE!

We are being stonewalled by the sponsors and they are not addressing our concerns here!

As a matter of fact Vicki.. you have spawned a new post by me to start a sponsor email campaign by us to get answers. Thank you!

                I agree on that one

I think its the sponsors themselves that should come forward willingly

I understand their dilemna but I think many webmasters are like me .. they'd prefer the truth than the silence. It gives us a perspective to view the whole picture from.

If I were pushing traffic to 5 sponsors
and sponsors 1, 2, and 3 were truthfull about their signing
and sponsors 4 and 5 never bothered to give me the courtesy of saying one way or the other, Its obvious who I'd do business with in the future

I'm HOPING some will take this advice to heart
there is nothing in the legalities to keep them from divulging this (unless they are CURRENTLY negotiating) and if it comes down to us having to find out from aca*ia themselves, it could prove more detrimental to them in the end.

Sponsors are in a bad spot legally speaking, but with that said many of those that settle are likely not going to be around in a year.

Also, while we webmasters are only affiliates, sponsors that settle may still face liability...ok, we NOT their agents, but they DO provide banners, content, etc for webmasters to use, plus provide, encourage, and most often *require* the use of specific links to specific internet locations by their affiliates.

So any affilate program who settles with Acacia better be ready for the lawsuits from webmasters - even if many are unsucessful, the cost of defending themselves will be enormous. And the damage to their reputation, well that goes without saying...

Ultimately, if the adult industry doesn't take on and beat Acacia, much of the adult industry will find itself at the mercy of other patent holders - Acacia isn't the only company on the prowl...if Acacia is sucessful, there's a whole swarm of others with zillions of other questionable patents ready to pounce on the industry with their patent infringement claims and manditory licensing.

Acacia needs to be stopped hard...an approach that may be effective is to get the EFF (eff.org) and the ACLU (aclu.org) on board...the Acacia patent claims are also a *direct assault on freedom of speech and expression*.

Many activists use video and audio...get them involved in the fight against Acacia - activists can help get the ordinary citizen interested in this issue as well as further help convince politicians that they need to actively work to reform patent laws pronto!

or are you saying you'd close it before giving acac*a the affiliates information??

what I'm talking about is sponsors letting webmasters know if they've licensed or not and if its part of their agreement that the affiliates are protected under their umbrella - thats it

vicki, i agree with you. what you said makes sense to me.

the only problem i see is that i have been told that acacia's license requires programs to give out that info. that could be bullshit, too. but if any program can license with acacia without bringing their affiliates into it, and it's best for their business - well, i wish they would fight for the good of our industry, but keeping their businesses going puts money in our pockets.

ARS is one of the companies funding the fight against Acacia according to Far-L:

Some of the companies fighting this, meaning actually engaged in a lawsuit disputing Acacia's claims include:

It is a relevant question to ask because you can?t be accused of inducing infringement if your sponsor has an agreement, because their would be no underlying infringement.

ARS should be supported for their willingness to take a stand and spend their own money fighting for all of us. [/B]
                                    Absolutely
After finding that out I changed some of my SSI calls to push them more traffic ... btw I took that traffic AWAY from a sponsor that so far has not bothered to tell us whether they've signed or not - like I said, to me they are lower down in my list than the ones that stood up and told us truthfully.

                                        2 sponsor rants since 97?

well make this my first public one since 96. They need to speak up and tell what position they took. If they haven't been contacted yet .. then I can understand their silence.

I completely agree that, while there is so much speculation and uncertainty, it would help if sponsors clarified their position whatever it may be.

and sooooooooo - the silence continues
I have yet to see a sponsor, that isn't already known to sign, take the initiative and come forward
                                              *sigh*
