TGP owner gets ACACIA letter...

I run 3 small ass TGPs and I received a letter from ACACIA today. So, I call them to see which domains they have listed and they had the correct ones. My first question to her was, how am I infringing? She said about the video blah blah. I said that I have no video on my sites, just links to galleries and sponsors. She said that I can't link to sponsors that have video. WTF? So, they come after little ol' me instead of the big sites?

I have to call back next week to speak with someone more "technical" she said. She said in order to stop this, I have to remove those links (uhhh... it's a tgp) or pay their fee. Anyone know what the fee is?

its just a sales letter not an official document. If they ever tried to actually sue me Id request a jury trial.

I think it would also be a good idea to get a group of like 50 people to file extortion complaints in the state of california. Using scare tactics to get people to pay illegal double dipping fees.

Ever notice that pretty much everything added to the Constitution after the original was a mistake.

As far as I know, anyone who is a small guy and doesn't make alot has to pay $1500. I think that is if you make less than $100,000 per year. Okay, so $1500 is not that much to someone who makes $90,000 a year, but what about the guy who makes $8,000 a year? That's OUTRAGEOUS for someone who makes like $50 a week with a small TGP or a couple hundred a week from TGP postings.

Just remember to send a letter to them and tell them that if they loosing in court, on the other lawsuits, you will sue them for your losses.

it seems to me like they are double and triple dipping........

theres no way it can be legal.
and if you are not providing any videos, and simply linking to sponsors that do use, its the sponsor infringing, not you...

their operation is so sloppy it isn't even funny.

Since when is posting a LINK on your site infringement on their patent?? No way, nope, no fucking way in hell will that fly. Sorry Acacia, you are way overstepping on this one. Posting a link is not even close to being the same as offering movies directly from your own domain/host/server. From a TGP, most actual movie files are TWO CLICKS AWAY. Linking to it is not the same as owning it.

Acacia is wasting money if they are going after TGP's.

If it were me I would 1) consult with a net-savvy lawyer

2) see #1.

In that order.

My own gut instinct would be to ignore them and see what they do, or send them an explanation letter, then ignore them, and see what they do. Like I said, linking to something is not the same as owning or being responsible for something. I can link to any sponsor I want, I'm not the one offering VIDEO directly to the end user, the sponsor is. The sponsor owns it, end of story.

As far as I can tell, the almighty Acacia hasn't a leg to stand on with this one, unless they now hold patents on hyperlinking.

A thread was started about babenet being a possible culprit to giving out names. You can count them out for me as I've never had anything to do with them. Matrix Content? I'm on their mailing list, but never bought anything from them.

if you were linking to child porn that would be illegal...but the sponsors you are linking to ARE NOT illegal ..thats why you can legally link to them, no video are your site they have nothing they can run after..

they cant tell you who to link to and who not to link to.

I'm in the same boat as you I just started in adult a few months ago, so I'm not making much yet. I allso only link to galleries with vids and have none on my own server.

All they are trying to do is scare everyone, honestly do you think they would try to take every TGP owner to court? and even if they did what would they gain? I'd say at least 60% if not more would shut their sites down b4 paying the money. So acrapica spends a lot of money on court cases and gets no gains... I personally don't think they will try sue everyone, I don't think they could afford it..

The problem is you can't ignore them or they will win by defualt... but this letter is only a threat/sales pitch.. you don't have to do anything intill you get served..

In November, you can vote for America's next president or its first dictator.
