    why am I left with the feeling that acacia might have gotten the idea that some people in this industry could possibly be willing to spend MORE money on fighting this patent thing than just paying the bogus patent fees and are somehow behind 'fightthepatent' in a financial collection kind of revenue scheme..............

    this actually makes sense.....

    make money from those that give in
    take donations from those that won't give in.


    hell why not ride BOTH sides of the fense.......

        The founding 250K will be in a war chest, that I then go to mainstream companies to seek larger amounts of donations.

        It is my intention to get alot more than just $250K to fight against patent abuses.. and I am seeking the eventual one-time donation... not looking to keep coming back to the well.. this isn't a dot-bomb, and it's not a yearly membership PBS drive, it's a one time effort to create something new.

            Yes, exactly!


            So right now, i am seeking Pledges. Pledges don't mean you give/donate/contribute money, it means you show your support and intent to give.

            No money is collected...

            When the pledge goal counter gets closer to the goal, then I spend my OWN money to formulate the corporation and file for non-profit status...

            Once ALL of the paperwork is done, and the 501c3 is formed, THEN, i ask for the Pledges to be turned into Donations.

            There is no contractual obligation to actually give money once it's time to receive the donations.

            So right now, there is no Fight the Patent Foundation.

            There is a concept as to what it is and what it will do, as documented on the website and in these posts.

            I am just trying to get support for the idea, to see if there is enough support from the webmasters that all will contribute to a common cause.

            It's unfair and unreasonable to ask larger players to fund this kind of organization...

            My approach is to seek out 2,500 webmasters who will pledge $100.

            Think about, getting 2,500 webmasters to pledge $100 is a HUGE task.... I have 2,500 reasons for failing.

                            The thing that everyone needs to keep in mind.... there are other patent holders with similar claims as Acacia. So the companies that settled now, will just be easy targets for others.. all they need to do is read Acacia's PR statements... rather than the wierd choices that Acacia has chosen to send out packets.

                            The current 11 defendants that are fighting back and waiting for their day in court, will be financially drained after their victory, who is going to fight the next round?

                            Maybe those that settled will see that this is ridiculous and choose to fight then... if they don't, then who will?

                            I did talk to latinasojourn on the phone, great guy, was incredibly disappointed when he called some bigger players and found out that they settled.

                                                    You are willing to throw away the opportunity of making good money for yourself and your family by settling for $3k per month.

                                                    This doesn't make sense to me because IMHO you should consider your family?s future first. We are nothing to you yet you are willing to do more for us than your own family?

                                                    I know you have stated that you are not motivated by money and that you have sacrificed a lot to fight this cause and this is what concerns me. Why would you do this at the expense of your own future and that of your family? Is it that you believe so strongly in this cause??

                                                          Thanks for pointing this out, I didn't explain the number i used, because no one had called me on it.

                                                          Given a starting fund of around $250,000, taking out $5k-$7k/month is alot on the burn rate, especially when you factor in attorneys and additional expenses. Let alone eye-brows raised immediately.

                                                          My wife just started working when I started up my activism, so her money covers the basics, the $3K would certainly help to live better.

                                                          I then go to mainstream to raise additional donations. 250K is not enough to take on some fights, especially with the way i would like to excute, so the money from webmasters is a one-time thing.

                                                          The rest of the funding, in greater amounts, I look to get from mainstream... from larger companies who understand how bad patents can costs businesses millions of dollars.

                                                          At the point when i raise significantly more money is where I would raise my salary to be compensatory to a fair level...bringing me to a normal level of income.

                                                          I am demonstrating my efforts now in sacrificing a little because how pissed off I am about these patent abuse cases and my desire to commit personally and professionaly to this cause

                                                            Yeah I understand that but Brandon is/was a business entrepreneur who has turned his back on his business which doesn't make sense. His background is not military, church or non-profits so why the sudden turn around. He was going to make money from the church with his audio software so he isn't a charitable person .

                                                            I'm not saying that he is not honest and genuine in what he's doing now but I would like to hear from him about this.

                                                                People have asked me, why are you doing this? Why are you giving up your personal and professional time to fight against patent abuse?

                                                                When I first read about Acacia on August 12th, i immediately shut down my website, registered FightThisPatent.com (since changed to FightThePatent.com) and started my first post.

                                                                As an innovator and tech-head, I could not believe someone would INTERPRET their patent to claim ownership to the process of downloading an audio/video file from a web server.

                                                                So I started my activism and winded down my consulting.

                                                                After a month into the activism is when I started to understand that this was my calling (it wasn't like God sent a message), but that I was very driven and passionate about this issue, that all of my professional experiences seemed to fit into this place.

                                                                So, combined with the movie 'Pay It Forward' and my observations along the way of looking for prior art and contacting people to bring awareness, I formulated what is the plan today called Fight The Patent Foundation.

                                                                Activists don't make alot of money... Lobbyists do... they make a whole lotta money.

                                                                I am ready to see this thing through to the launch of FTPF and the execution of the charter.

                                                                There will be a point, where I can step back and pursue my other ventures, since other people will be taking on the movement and carrying it forward.

                                                                FightThePatent.com is a one-man personal crusade, that has evolved into the start of a movement.

                                                                That pledge counter below is proof that I am not alone.

                                                                The other threads of people looking for prior art as well is proof.

                                                                The many, many emails a day that I get and the phone calls with webmasters is proof.


                                                                The final proof is when that pledge counter hits $250K.

                                                                I don't like bootstrapping, already did that with other businesses.. this time, their will be better watch on budgeting things...so that's why I don't accept money now, i would just be burning through it.

                                                                I am taking pledges and paying for my own time to start this endeavor, until the goal can be reached.

                                                                        I deserve to be scrutinized and questioned.. but for those that do, I hope they will be able to shift their point to one of support when they see that answer after answer, i am consistent.

                                                                        I know that some have joined me recently because of this thread that started out on the opposite side.

                                                                        Only through open communication can ideas and solutions be found.

                                                                            You can hide from it.. and some do, the experts that I try to reach have moved away from technology so why do they care about this?

                                                                            You can try to run from it.. but with a business, you are anchored and the patent holders will try to find you like Acacia has been doing.

                                                                            You can fight it.. ... but if you are just one person slugging away at every bad guy that comes around it does wear you down.

                                                                            That's why it takes a movement of people all believing in the same goals to make a difference.

                                                                              In your example, you are the content provider, so you are "using" their patent process and therefore have to pay a license.

                                                                              A website that links to your video, hosts video on their website, is assisting in distribution, so therefore they have to get a Webmaster license.

                                                                              So that's why Acacia asks a content producer who their customer are (they ask for a list), so that after the content producer pays the license, then they can target the websites that use the content.

                                                                              He said they went after the primary source.. So if they are trying to charge fees to different people for the same video/stream, yada yada, then this would be illegal by his own statement..

                                                                                  If you listened to the 3Q conference call, one of their shareholders asked if about any open litigiations, and whoever answered dodged around the answer to effectively say there were none.... there are 11 defendants waiting for a court date! Litigation has started!

                                                                                  Mispresentation of information is big no-no to the SEC.

                                                                                  Let's check their stock, should have been up after the call... oh gee, down 7%....wonder if day traders are actually able to read between the lines and see the truth.

                                                                                      So far, only one company appears to have escaped Acacia's grasp: Holio.net, an adult content provider. According to court records, Judge Alicemarie H. Stotler tossed out Acacia's compliant of patent infringement on Sept. 10 without prejudice; so far, Acacia's amended complaint of patent infringement has not been used.

First of all, reading through the thread, I was disappointed I didn't see any mention of what I consider to be one of the best points for the formation of FTPF, the "pay it forward" concept. Has this idea been dropped?

                                                                                                  Secondly, what you envision is much needed at this time, no question about that. And I'm glad to see someone step up and try to make it happen. However (and this is where the doubt begins to creep into my mind) a foundation is one thing and a personal crusade is another. Can you see how some people may be reluctant to commit to FTPF at the outset of your effort, before having established any track record?

                                                                                                  Ending in a statement of my own personal feelings, I do hope this can get sorted out, one way or the other, fairly soon. Because, if FTPF is not going to come into being, all this energy and effort, that could well have been spent directly fighting Acacia at this point, will have been somewhat a waste. Except to prove, once again, that this industry is possibly balkanized beyond redemption and we should have no complaints whenever someone does finally consolidate everything into "The Big Three".

                                                                                                    1) I believe Squirt's question violates my patented approach to this thread in that I don't believe his question is relevant. Should Squirt come up with how the answer to this question is relevant to FTPF, then i will answer.


                                                                                                    2) The movie 'Pay it Forward' heavily influenced my thinking in forming the idea of Fight The Patent Foundation. As I was contacting people for prior art and expert testimony, i ran into many situations where these people did not want to get themselves involved into other people's issues. While they did help to innovate technology, they have since moved on to other endeavors, and so i have many email responses from people saying they understand the problem, just don't have the time to help.

                                                                                                    The key factor of FTPF to helping find prior art and get expert witnesses to come forward is to offer a donation to their favorite charity, in their name, for taking the time out of their lives to help. Most of these expert witnesses are not motivated by money, but could be motivated to step forward knowing that their efforts would be 'paid forward' in helping the defendants against a patent abuse case and to help an organization that they support.

                                                                                                    As a non-profit organization, FTPF will be able to accept items like computers, etc from companies as a way of donating to organizations in support of the 'Pay it Forward' concept.

                                                                                                    In addition, FTPF will use a grassroots approach to finding prior art, by having a volunteer army of searchers who can submit their prior art leads to the website, and will get awarded points for their finds, and be rewarded with prizes, cash, etc.



                                                                                                    3) I can see that as a possibility... I have already received accomodations from Spike and Far-L in numerous posts, as well as endorsements at http://www.fightthepatent.com/v2/Fou...dorsements.php
                                                                                                    for the effort that I have put in. It would be unfortunate to have to wait until Acacia's patent was invalidated for people to see that I do have the right approach to fight against patent abuse.

                                                                                                    The defendants could be stuck in court for many months, maybe even years... while they are in court, Acacia can still go after other webmasters, so waiting for the outcome only hurts those that need the help the most.

                                                                                                      The huge problem with Acacia is this: (to use a car analogy).

                                                                                                      They patented a personal transport with 4 wheels.

                                                                                                      Someone else cited them in their own patent, but called it a car with low ride suspension.

                                                                                                      Acacia comes out to sue the auto dealers for patent infringement of selling cars with wheels, which they say is the same as a personal transport. They could sue the manufacturer, but they have deep pockets, so they pick on the smaller dealerships that have tight margins and high overhead (ie. inventory).

                                                                                                      In this simple example, Acacia is looking to sue everyone for a broad patent claim... the problem is that so many companies were making "personal transports" prior to their patent, that the patent claims should be invalid.

                                                                                                      But why would the USPTO grant this fictiious patent then if there was prior art? The language in this patent was so obscure and science fiction like, talking about the ability to turn invisible, transform into a robot,etc.. that the patent office thought it was novel and new. but acacia decided to just focus on the broader claim of a car with wheels.

                                                                                                      But some auto dealerships decided to fight..they didn't want to pay someone a licensing fee for the sales of their pimp-mo-biles. So these dealerships fight back by challenging the big bad patent.


                                                                                                      Hope you have enjoyed this analogy to explain how absurd this Acacia patent is.
