Canadians receiving Acacias letter

    Canadians receiving Acacias letter

    This morning I received acacia's second letter / warning about how I am infringing on their patents.
    The letter was addressed to "ladies and gentlemen" @ my company to my home address.
    Obviously this was really thought out...

    The letter states how they previously contacted me "regarding unauthorized use of certain audio or video techonolgy covered by patents owned by Acacia."
    In the letter they sent there were mentions of a Few large adult Ent companies that settled...ie: Hustler, Ce, Sexcheck Avs, Vivid Ent & Wicked pictures. All in all they say 47 comapnies have signed.

    They also have included 2 Very Nice Glossy Cnet documents titled;
    "patent holder unplugs porn network" and "broad patents on streaming media upheld".

    Now I have a very good idea how they got my info, because my company was created fairly recently and the way it was addressed hints to some sort of foul play on a fairly large sponsors part.

    My companys address is an office and not my home and is listed as such in my whois and all company records.

    The only people that have my company name and my home address is one sponsor that I signed up with just after I had reg my corp.
    I dont use many sponsors and most if not all are under my name at my home address from all my past dealings.
    This time I was unsure if wanted my checks to come to the office because of some irregular mail issues I was having so I used my Home address for the checks to come to.

    I also should mention that I do not have a US entity, the only thing that is in the USA is my host.

    How is it that an organised company sends what seems like threating letters in such an unprofessional manner?

    More importantly how do they know people are actually receiving these letters if they send them by regular mail?
    I mean for all anyone knows the shit can get lost in the mail, theres no proof that I received anything let alone take me to court.

    Shouldnt they be sending these letters by registered mail to avoid the hassles, and have proof that they contacted all these companies?

    I would think that a comapny trying to take 200mill a yr of adult webmasters would at least get its ducks in line so that it can pave a smoother road for what seems to be a pretty big battle cosidering the efforts of the IMPA.

    Considering that Acacia does not hold ANY patents in Canada for streaming media, how do they expect to uphold them here?

    Your address wasn't given out by anyone who settled. Acacia has a large crack legal team; It's not difficult to find you. All they need to do is find your website and they'll be able to trace it right back to your front doorstep.

    First you get their little info packet, then you get warning. Then they'll serve you.

      Contact your lawyer.. If you are a canadian but have a US corporation, or you host in the US, I believe you may still be subject to acacia's patents.

        Rochard, As much as I beleive what your saying you fail to understand that the way the info was presen sent to me only one other company has it this way. It they have had it for less than 60 days. They are alos not mentioned in the Acacia letter so it makes me wonder if and when they signed.

        Even the governement here doesnt have the misguided info that acacia addressed me with.

        They sent my company mail to my home address, makes no sense because it isnt listed that way anywhere on the net except for one sponsor that has it this way because thats how *I provided the info when I signed up.*

        Crack legal team or not, they didnt get this info from my Whois i can gurantee you that!

        Anyone that actually read what I wrote have any thoughts?

          I knew the finding homes addresses issue would show up and I do believe you are correct in saying it probably came from a sponsor. I don't think domain name providers or hosts would give out personal information not on whois without a subopena. OH, but what do I know since I am not an attorney ..

                      I received the very same package this morning. this is the first time I heard from them. And yes it was adressed to "Ladies & Gentlemen" at my company.

                      I am in Canada and so are my servers...

                            Ok guys.

                            I GUARANTEE you that affiliate programs lists have been used by Acacia to send out packets.

                            I will give you an example from here in Australia. Months ago a guy came to my house with an Acacia packet. The packet was not addressed by his name, but his affiliate account name, which was somewhat obscene and he was embarrassed because he knows the people at the post office and didn't want his adult business known, and now it was out.

                            Yes the packet was not addressed to him, his affiliate name.

All of our mail runs through a PO box. Anyone who has settled with Acacia did not have this address. Even though no mail comes to the studio and no one in the industry has the address, they were able to find it - Be it through our ISP or our bank, or the deed on the studio.

In less than two months I knew everything about him, including every car he ever owned, every state he had a driver's license in, every residence he had ever owned, and even his bank statements. Anyone can do this.

                                  Then imagine what an attorney can do.

                                  I'm not saying that the companies who settled didn't give out this info (nor am I defending them). I'm saying it's a lot easier to track someone down no matter how hard you try to hide.

                                      1) Sponsors will give up names of affiliates.

                                      2) Get an opinion of infringement from a Canadian IP attorney. If the opinion is favorable (the fee is $150-$1000, so it will be) you are protected from charges of intentional infringement.

                                      No patent is registered here but if you have any kind of real business assets and something to loose its a good percaution.

                                            Rochard, while I appreciate that you can get a ton of information if you have the right starting point, I think that you are giving Acacia credit for taking to do more than their M.O. says they would.

                                            If they had it by domain, they would do a whois and away you go. There isn't ANY SANE REASON to go any further than that, unless they have served you and failed to reach you (registered mail bounced, example). Otherwise, just do a whois and away ya go.

                                            Please also remember that the Hustler folks said that they had negotiate some sort of exemption for all their affiliates in their agreement with Acacia. This would suggest that they provided a list of those affiliates to Acacia to work with, no? It wouldn't be hard for them to use that list as a basis of a double dip campaign.

                                            I wouldn't think Ken and the people at Flynt have any bad intentions, but Acacia appears to not have the same level of self control.
