This morning I received acacia's second letter / warning about how I am infringing on their patents.
The letter was addressed to "ladies and gentlemen" @ my company to my home address.
Obviously this was really thought out...
The letter states how they previously contacted me "regarding unauthorized use of certain audio or video techonolgy covered by patents owned by Acacia."
In the letter they sent there were mentions of a Few large adult Ent companies that settled...ie: Hustler, Ce, Sexcheck Avs, Vivid Ent & Wicked pictures. All in all they say 47 comapnies have signed.
They also have included 2 Very Nice Glossy Cnet documents titled;
"patent holder unplugs porn network" and "broad patents on streaming media upheld".
Now I have a very good idea how they got my info, because my company was created fairly recently and the way it was addressed hints to some sort of foul play on a fairly large sponsors part.
My companys address is an office and not my home and is listed as such in my whois and all company records.
The only people that have my company name and my home address is one sponsor that I signed up with just after I had reg my corp.
I dont use many sponsors and most if not all are under my name at my home address from all my past dealings.
This time I was unsure if wanted my checks to come to the office because of some irregular mail issues I was having so I used my Home address for the checks to come to.
I also should mention that I do not have a US entity, the only thing that is in the USA is my host.
How is it that an organised company sends what seems like threating letters in such an unprofessional manner?
More importantly how do they know people are actually receiving these letters if they send them by regular mail?
I mean for all anyone knows the shit can get lost in the mail, theres no proof that I received anything let alone take me to court.
Shouldnt they be sending these letters by registered mail to avoid the hassles, and have proof that they contacted all these companies?
I would think that a comapny trying to take 200mill a yr of adult webmasters would at least get its ducks in line so that it can pave a smoother road for what seems to be a pretty big battle cosidering the efforts of the IMPA.
Considering that Acacia does not hold ANY patents in Canada for streaming media, how do they expect to uphold them here?
