    Have I been owned? Re: content license

    I bought a set of mixed gay content from a well known and reputable content provider today. I am not going to say who they are because I've contacted them and I'm waiting on a response. But I've got some problems with the set. First of all, I believe one of the pics is from scarlett.net off off one of their Scarlett Hunks CD's (and I think I own that one, I just haven't had time to look through it, yet) AND (get this) I am 99% sure that one of the pictures is Mark (Marky Mark) Whalberg and that he has been photoshopped to look nude. Many of the images in the set are also photoshopped.

    I hope I didn't jump to conclusions, but what do you guys think. Isn't this Marky Mark? I'm pretty sure the content provider themselves are not responsible, but have I been owned by whoever is selling this set through this particular broker?

                                          I'm a she, but, yeah, I feel kinda owned. I certainly didn't expect this buying from a reputable content provider.

                                          And I would imagine that the broker doesn't even know that this set isn't legal. They are not based in the U.S. and they may not even know who Marky Mark IS much less be able to recognize him. I honestly don't think it's the broker's fault because they broker for alot of people.

                                                                                  No, I certainly did NOT want celebrity pics. I bought the set to design gay BYOT tours and I honestly couldn't believe there was a celebrity pic in it. I'm not about to risk my ass for something so dumb.

                                                                                  I bought it from a reputable provider that posts on this board on a somewhat regular basis. I have bought from them for quite a while with no problems. I assume this is just some guy claiming to own these pics and the broker has no idea. That's why I'm not naming names.

                                                                                      Going by what was said... content was bought from what was supposed to be a provider with a good rep. And this content was not in line with this providers rep - why or how would you read anything into that? She got ripped off, its not her fault - and even if she was 'crying' about it - well dur, she got ripped off here.

                                                                                                      Maybe it has something to do with researching the provider thoroughly beforehand, knowing EXACTLY what I'm buying, and not accepting anything less than the specific set I purchased.

This is why you should have 2257 documents for every picture on your site.

                                                                                                                                                  Tootie could have put up these pictures and ended up in a lot of trouble, because of a lack of diligence.

                                                                                                                                                  Have the ID shots, make sure one of the documents contain a signature, have a signed model release. Compare the pictures in the IDs to the ones in the content, compare the names of the models on the model release and the IDs, and compare the signatures on the IDs and the model release.

                                                                                                                                                  If the "Reputable" content provider had done all this for you he would not have made the mistake in supplying these pictures. Always insist on 2257 documentation so you can check for yourself. If you do not have the time or simply cannot be bothered to do this then do not complain if you get ripped off.

                                                                                                                                                          It is unfortunate that there are many, many content providers that do not provide these documents (most claim it's because of privacy which is stupid because they can black out the address and such) at all and it can be very difficult to find the type of content that I need even WITHOUT taking this into consideration. I do buy at least 80-90% of my content from providers that do provide the documentation, but it's also the 10-20% that I DON'T that could get me in trouble.

I wanted to wait until this was resolved, but no point in that now. At least maybe I can stop someone from buying this set by mistake, as I did, before the broker has time to remove it.

They are not based in the U.S. and they may not even know who Marky Mark IS much less be able to recognize him. I honestly don't think it's the broker's fault because they broker for alot of people.
                                                                                                                                                                                          They should still be asking for proof of ownership AND documentation on all pictures in any sets they broker. In the US or not, their CUSTOMERS are US. I seriously think you should make an issue of it with them. I know EVERY SINGLE set on my content site, and I've seen docs (and have docs) for EVERY SINGLE SET. If I hadn't, they would not be on my site, PERIOD. Any question, they are either not put up, or they are pulled. And I'm not in the US either, therefore not subject to 2257. For the sake of my CUSTOMERS, however, we conform to ALL aspects of 2257. As a provider of an important service, we (and any OTHER content provider for that matter) should do NO LESS.

                                                                                                                                                                                                      In 2003 and under an administration that is targeting porn publishers anyone selling anything remotely adult, are in the States or have any part of their business there, hosting, CC processing, etc. Has to have the 2257 documents on their premises.

How well do you know the supplier? It seems well enough to put your freedom into the hands of a guy in another country. It also seems if he is morphing heads onto bodies you need to rething your "Trust" levels. We need guys like you to raise standards not lower them.
