    Acacia Technologies Licenses Digital Media Transmission Technology to Dellwood Holdings

    NEWPORT BEACH, Calif., Sep 15, 2003 (BUSINESS WIRE) -- Acacia Research Corporation ( ACTG )( CBMX ) announced today that its Acacia Technologies group has entered into a License Agreement for its DMT technology with Dellwood Holdings, A.V.V., an Aruba Company that owns and operates over 100 well known adult websites, as well as a popular Age Verification Service that provides access to over 50,000 websites.

    Acacia has now entered into 38 license agreements for its DMT technology.

    Acacia's DMT technology, which is covered by pioneering patents, relates to audio and video transmission and receiving systems, commonly known as audio-on-demand, video-on-demand, and audio/video streaming, and is used for distributing digital content via several means including Internet, cable television, and wireless systems.

                                                                      The Larry played by Woody Harrelson who saved porn in the movies is not the Larry of reality.

                                                                      Don't expect Larry to come in like a white knight here. In fact, don't be surprised if Hustler settles. Why wouldn't they? Acacia has offered them a sweetheart deal because, imo, they know that if Hustler caves in then a ton of others will follow suit.

                                                                      The worst part is that every settlement offer I think Acacia has made so far has involved getting off by selling out on those around you. I think I heard Hustler was even offered a cut of adult licensor revenue to do a deal.

                                                                      What would you do if you were the real Larry Flynt and not the fictionalized version? Would you want to spend tons of cash to fight for everyone elses right not to have spend cash or would you take a deal that would potentially give you a cut of almost every adult site's gross income?

                                                                      There are no heros here. Only businessmen and women who have to make difficult decisions.

                                                                                          I really don't know all the details, but by making ANY type of settlement is agreeing that THEY have a right to be paid and if that is the case, why go to court over something you have already admited to?

So here is a company making claims, here is another company(s) stating they have no claim and that they cannot do this, yet on the other hand they are paying them for the use of this as if they have a right to be paid then fight them as if they don't....

If you strongly feel that they have no right to collect money from you for your streaming... then DON'T settle.... Stick to your guns. Now this company can come back in court and say.... "Well, if we didn't have a right to be paid for the use of our technology, then why are these companies settling?

                                                                                                      frankly, in these wild legal times, i don't fault any of these larger companies for settling because in effect it squashes their beef and they can move on to bigger and better things. as LM said, the money that they are garnering off these settlements can't begin to justify their legal expenses. my guess is these companies are settling for beans just so acacia can claim that they have these people under their belt.

                                                                                                      in this case, it's up to the littler companies to group together because acacia doesn't stand to make as much money off of them anyway as they would these larger companies. once their patent is invalidated (i am more than confident it will be - their allegations are a tad bit farfetched), i'm sure most will question the resolves of the companies that decided to settle and their faith in the industry, but you have to understand that larger companies cannot afford to put all their eggs in one pie-in-the-sky basket. it's a strategic move on the part of the company that i'm sure we can all understand on some level.

The company that created the software to stream would be the one at fault... All we did was buy their product. If they are selling stolen technology they are the ones that should be in the courts.. not us. After all, they are still selling the software to stream right?

Pretty tough to go into court and say "CE caved so should everyone else" when both parties agree that the patent is questionable.
                                                                                                                                          Also you can settle without admitting guilt or wrong doing.

                                                                                                                                                      Rob Berman explained clearly why Acacia is not going after Microsoft and others.

                                                                                                                                                      They do not see it as a profitable or necessary. Acacia considers the streaming technology supplied by those companies as just a single elelment in their patent and not the full method.

I can see the v chip thing they went to the companies that built the TV'S . We dont build the software that streams, its the software companies using their technology not us. How come this hasnt been brought up in anyof the interviews or radio shows? I drive a taxi ,I dont have to pay a licensing fee to the guy who invented the transmission, thats Fords responsibilty. Maybe thats how it should been approached in court instead of a patent battle.

They can enforce their patent against whomever they feel it applies to. They are not only going after the adult industry. Berman has made it clear that they could go after mainstream media sites like the sports sites that D$ asked him about.

                                                                                                                                                                          You have stated that there is no money in going after mainstream... but I would think there would be more, especialy going after the companies who have created the software using the stolen technology.

                                                                                                                                                                          Personally, I am still new... just opened my program last week... if they were to come after me.. they would get nothing, I have nothing for them to get... I am not making a ton of cash yet... hope to, but as of today... I am just some slob working out of a spare bedroom trying to make a buck. Let them come....

I mean they are the ones providing the tools, the hosting companies are providing the streaming servers, all we are doing is making videos... How are we responsible for these royalties is what I am having a hard time understanding...
