How exactly would you prove damages in a case like this?
Just because someone says something bad about you doesn't necessarily mean it has cost you any money.
Won't you have to put an exact dollar figure on the damage he has done?
For example, if right after he made those statements, you lost a bunch of your trades because of it, you would have to calculate your loss of income due to the loss in traffic, etc.
What I'm saying is that I believe you have to prove monetary damages, which would be hard to do in a case like this, (unless you actually lost a bunch of your trades.)Comment
