Man sued for web trickery

WASHINGTON (AP) -- A man who has been sued 63 times before on allegations of designing and making millions from Web sites that trap users has been sued again by the Federal Trade Commission.
The FTC said Monday it hopes to stop John Zuccarini of Andalusia, Pa., from creating Web sites with names close to popular companies or celebrities, then using Web tricks to keep the unsuspecting user from leaving the site.
One copycat Web site, named after tennis star Anna Kournikova, springs up 29 new Internet browser windows. When the user tries to close the windows, the buttons are either disabled or spawn new windows. This method is sometimes called "mousetrapping."
"Scams that capture consumers and hold them at sites against their will while exposing Internet users, including children, to solicitations for gambling, psychics, lotteries and pornography must be stopped," FTC chairman Timothy J. Muris said.
Zuccarini did not reply to an e-mail sent to an address on one of his Web site registrations.
FTC investigators said Zuccarini makes from $800,000 to $1 million per year by charging advertisers whose ads appear on the browser windows.
Many of the Web sites target kids, including 15 variations on the Cartoon Network's Web site, and 41 variations on the name of pop singer Britney Spears.
Even when the browser windows seem to be gone, the trap may not be over. FTC investigators said Zuccarini's sites sometimes use a "stealth" Web page that's hidden from view and acting as a timer. Periodically, that page launches new pages.
The FTC said Zuccarini has lost 53 state and federal lawsuits and has had almost 200 Web addresses taken from him and transferred to copyright holders.
It said Zuccarini does business under many company names, including 22 names using the word "Cupcake." Victims of the scam should contact the commission at 1-877-382-4357 and use the FTC's case name, "Cupcake Party."

Under the new amendments, which U.S. president George W. Bush is reportedly eager to sign into law, the operator of a pornography site caught misleading Web users could be fined and face up to two years in prison.
The penalty would be harsher if the deception is aimed at children. "Whoever knowingly uses a misleading domain name with the intent to deceive a minor into viewing material that is harmful to minors on the Internet shall be fined under this title or imprisoned not more than 4 years, or both," the amendment reads.
It explains later that any Web address containing the word "sex" or "porn" would, obviously, not be deemed misleading.

Most of you are still failing to grasp how it works. They go after a pig like this to get favorable case law on the books. Once an appeals court rules that the truth in domains law is constitutional then law enforcement has a free hand to go after the Persian Kitties, the Brittany Blus and so on. It is the same deal in the Rob Black case. The go after the worst in order to get case law that benefits their cause on the books. In this case the Prosecution would present the case like this to the court. ?But judge if you don?t uphold the this law people will be free to register Disney, and other domain names that target kids.? It will be very hard for the courts to side with the defendants. And notice how it is being presented ?entice children to pornography? This guy had 3,000 domain names how many of them were kid type names 1-2% or less? I did skim through some of that and what I found that was interesting is that the postal inspector took the language from the warning page, and used it evidence that the person knew that there was sexually explicit material on the site, and in conjunction with no real age verification system (A warning page wasn?t enough) he was intentionally allowing children to access the porn. So in other words any mere nudity sexually explicit or not is actionable at least according to the person that signed the affidavit. He also used to use sponsors such as CEN and ARS. Those "kids sites" mostly went to Hentai and Teen Sex sites, they weren't targeting kids at all, but I guess I can see where it pissed people off.

If they are going to target any domain that does not have the words sex or porn in the domain name then what choice would the sites like persian kitty and the hun have but to go to a dot xxx extension to throw up the flag that they are a porn site.
What this guy did with the typos is pretty shitty but how far is the government going to go with trying to force us out of business. I agree that they are probably using this guy as an example to set legal precendence and now that they have a favorable judgment they will now go after the "other" domains and use this judgment as a basis for their arguments.

I highly doubt the government would ever be able to push all adult sites to an xxx or any other particualr set of extensions. It will probably be more like, they will start some sort of list that is updated daily that we all have to reg on in order for parents to lock those sites out of their own computers. Don't know how they would lock them out and at the same time keep the kids from over riding it, but thats their problem. I don't know how to program. lol

I remember when Playboy etc was on the OPEN shelves in stores. Parents fussed and they stuck them behind the counter. More fussing and they went UNDER the counter or had their fronts covered up. I remember when Playboy etc was on the OPEN shelves in stores. Parents fussed and they stuck them behind the counter. More fussing and they went UNDER the counter or had their fronts covered up. Did it totally prevent kids from getting them? Ummm Some markets are run by kids under 18 in the afternoons. Their buddies come in and buy the mags. Of course they pay an extra 5 bucks for that. lol
I remember that too. When I was growing up in a small town of 1,000 in the Midwest our local grocery store had Penthouse, Playboy, Playgirl and a few other adult magazines on the top shelf of the magazine rack. First they covered them with plastic, then a year or two later they moved them under the counter where you had to ask for them and a couple of years later they quit selling them altogether because nobody bought them anymore as they were hidden away. More recently we have Wal-Mart removing FHM, Maxim and other like magazines nationwide because a few prudes complained about it. I don?t call that progress.
What too few people fail to realize is that these religiously insane people won?t stop their crusade on Internet porn until they have been successful in doing to it what they did to magazines in the last two decades.Comment

Too true Kingfish. Back in the 70's a religious bunch actually dynamited a Lions Den Adult Bookstore. They had been protesting it for quite awhile. What they didn't know was there was an old man inside (hired to call the cops if the idiots broke in) Luckily his mattress saved him. Funnier, during the investigation, it came out that some of the protesters were customers. rotfl

I'm all for a PG kids only internet, great idea...we keep kids out of bars don't we. This should separate things nicely. Again it's going to be up to the parents to see that kids aren't entering the general internet. Too much trouble can be gotten into there, even for adults, like all big cities.
Would save a lot of issues for everyone. WHY NOT? is the big question. Forget about .xxx Most of all the nutcases who have such a hard-on for internet adult providers, would be pleased as should the rest of us, or would it just take away some of their amo? is that the real problem...
The people who market things to kids may not like this, since kids can't purchase services, but they can sure bug their parents, just like McDonalds and kid's cereal, it's crap but it's for kids.
How long has the internet been around that we haven't done this already...what's the hold up...so we can all just move on.

There are millions of things that kids search for doing school reports that would never get included in a "kids-only" internet. Not only because they're "questionable" by someone, like breastfeeding, but also because it would just be such an expense to make a clone of the site for the .kids extention with certain things taken out.
And who decides what gets approved for this and what doesn't?
Will the current filtering software rules apply? If so, you'll block out any pages with the word "breast" - robbing kids of important information concerning puberty, checking their breasts for lumps, exercises for their breasts, breast feeding, etc
What about a human editorial committee? Okay, then you get opinions on what "should" and "shouldn't" be included... and you lose important information like the atrocities that happened during wars because it's "too much" for the kids, and shit like that.
I think porn sites should be moved to a .xxx extention. Yes, it would kill "spontaneous" buyers, but anyone who's relying solely on that traffic for their income needs to ground themselves in reality anyway and learn something new.Comment

Some dialers auto-install themselves, disconnect the user and reconnect to the porn site at however many $$ per minute.
The ones that don't auto-install pop up on the screen, the kid just clicks "okay" automatically thinking he's gonna get to see a naughty picture OR that clicking "okay" will make it go away... the dialer installs itself, disconnects the user, reconnects to the dialer system at so many $$ per minute...
A million per year is easy using tactics like that, especially when most dialer rates are around or over $1 per minute.Comment
